I mentioned this incident in the "Vape shop owner..." thread a couple days ago. The NRA Rifleman magazine wrote it up in their "The Armed Citizen" column, which usually reports on lawful self defense news stories.
Sorry, didn't see that reply to that thread until now. Still, I guess it
now deserves a thread of it's own, since you said
"The incident was written up in the current issue of the NRA American Rifleman, using only the original news story, so from that it sounded like a legit case of self defense. Maybe not."
Using the original news story it sounds like a legit case of self defense to me too, but then initial news stories leave out a lot of important information when it comes to someone being charged or not. Also, things can pop up after the event, like new evidence or the shooter's past or previous words can come up. Or the prosecutor could possibly just be a malicious prosecutor.
Not accusing this prosecutor in this case, I just know I've seen it occasionally happen in the past. Sometimes they even admit it, when one DA specifically said to the effect (can't recall exact words from years ago) "this indictment sends a message that vigilante justice will not be tolerated."
It's not vigilantism to be defending yourself from a crime. The defendant spent a lot of time in jail awaiting the trial and verdict, because he was innocent and refused to be railroaded by the system and take a plea deal. He eventually
won, at great expense to the defense and the taxpayers for prosecuting that case, but he went thru hell to get there.
