Oberlin slapped for $11 mil for playing race card for robber
Gibsons Bakery was robbed by Oberlin students and the robbers were apparently roughly apprehended. The staff at Oberlin riled up the masses and street protests erupted. It turns out race had nothing to do with it. The $11 million is essentially for defamation...ie you can say what you want but not it you know its not true and it harms another. This verdict will maybe give some pause to this practice. Too many make this accusation where it is patently false and it hurts credibility when it actually is true.

Not quite. There was only one robber and he was not roughly apprehended. It went something like this: one underage yoot tried to shoplift a bottle of wine. When he was verbally confronted in the store he chose to assault the employee, upgrading it to robbery, a felony. That employee pursued the young fellow, which he was permitted to do under both the shopkeeper's privilege and the citizen's arrest law. It was never made completely clear what happened from there, but by the time the law arrived the shopkeeper was the one on the ground being assaulted by the suspect and some of his fellow scholars, who apparently were not involved in the original incident but saw the pursuit.catfish86 wrote:Gibsons Bakery was robbed by Oberlin students and the robbers were apparently roughly apprehended.
To your point, this does illustrate why one must be certain who is at fault before jumping into a fight on the assumption that one particular party has the right to self defense. All scholars involved were charged with felonies, but plead guilty to misdemeanors with the victim's consent.

To paraphrase the English officer who elected to receive the initial volley of musketry so that his command could respond at a more effective range, "May Oberlin be truly grateful for what they're about to receive..."

The staff from Legal Insurrection have had someone in the courtroom for the entire trial, and have written up excellent summaries of all the pertinent points.
If you're interested in the case, I'd highly recommend them:

And the fiasco continues. Oberlin is asking for high punitive damages at this point.

Yup, probably. The post-verdict email could be Exhibit A at the punitive damages hearing as to why the compensatory damages are not sufficient to send a message to Oberlin College and its administrators.

Another great Legal Insurrection story about why the original verdict came to be, and a good discussion of the general Lorain County mindset and jury pool:

Looks like the jury was not impressed by the college.

Solid precedent.
God Bless the family that stood up and didn't capitulate when the world was against them.
Jury trials, ladies and gentlemen, are the way to go.
God Bless the wisdom of this jury.

There are two things about this case that are very important, of which some of the commenters and tweets I read are missing.
The first is that Oberlin College, in the minds of the jury, wasn’t guilty only of what they did, but also what they didn’t do. They had opportunities early on to see the {inappropriate language} flying in their faces — thrown by the social justice warrior students – and didn’t have the good sense to see a basic problem and recognize the simplest of solutions.
What happened here is that Oberlin College and many universities have lost the understanding of their identity and basic purpose, and when that happens with most of us, when we don’t know who we are, we tend to do stupid things. That’s what happened here.
A few years ago, they had students saying they wanted finals cancelled because they were protesting minority men being shot by police in nearby Cleveland; in Dec. of 2015, the school’s black student union published 14 pages of racial accusations against the school with 58 demands to fix them; and the school had students thinking that the sushi in their cafeteria was “cultural appropriation” and unfit for eating because of that.
Instead of the school telling their students, “You are all crazy, and get back to studying,” they took on the “these poor snowflakes need our support” attitude.
It was the tail wagging the dog in the end, and ended up how most things like that do.
The second point I’ll write about here is where it happened and why, and the timing of that. The town of Oberlin is a tiny spec on the map of Lorain County, Ohio, where this case was tried. Based on the jury questioning prior to the start of this trial, none of the eight selected were from Oberlin or graduates of the school. So, it is not like the university overlords were being sacked by the peasants, as some who do not live in Northeast Ohio have speculated.
This county has been a former union worker Democratic stronghold, but one that has seen in the last 40 years its manufacturing base ripped out and its housing value plummet, and still most home prices are still in the Rust Belt dumpster from the Great Recession. That was a big part of why this happened where it did.

From the Oberlin statement:
Raimondo handed out flyers detailing the baker's "racist track record" and had a bullhorn at many of the rallies if I am not mistaken. It's whoppers like this one that tend to get jurors' attention. The university is stuck on stupid.“Neither Oberlin College nor Dean Meredith Raimondo defamed a local business or its owners, and they never endorsed statements made by others," Varner reportedly said.
