I believe that I am not allowed to drin AT ALL while carrying in Ohio. I have a friend who says she can go to a bar or restaurant and drink as long as she stays under the legal limit and her ccw instructor confirmed that.. she wants to place a wager...who is right?

What's the question?

Drinking at a restaurant is a felony, irregardless of the amount.
Drinking at your home is legal as long as you are not intoxicated.

That's the short answer.

she says she can go to a bar and drink a beer while carrying as long as she does not go over the legal BAC limit... I say ANY drinking at a bar or restaurant while carrying is a felony...who is right?

(A) No person shall possess a firearm in any room in which any person is consuming beer or intoxicating liquor in a premises for which a D permit has been issued under Chapter 4303. of the Revised Code or in an open air arena for which a permit of that nature has been issued.

(1) This section does not apply to any of the following:

(e) Any person who is carrying a valid concealed handgun license, as long as the person is not consuming beer or intoxicating liquor or under the influence of alcohol or a drug of abuse.




I see no limit there. I'd say you are right.

yeah she is now saying the instructors wife is a lawyer and they both told the class that as long as they are not legally drunk they are ok...

I wish these instructors would just say I don't know if they don't really understand the law...

Steve if I was in your position I would print out that section and go hunt down the instructor. You would be doing future students a huge favor. Past students too if the instructor sacked up and did the right thing.
