Pulled Over In Michigan
All:
Yesterday, I got pulled over for allegedly ignoring a "No Turn On Red" sign. We don't have the goofy "plain sight" rule Ohio does, but I handed the LEO my CPL along with my driver's license and told him "Sir, I am legally armed." as required by Michigan law.
He was pretty cool and let me off with a warning because my driving record was good.
Whew,

Not only do you not have plain sight, but from what I've read, behind the wheel is one time when open carry is NOT legal. Meaning us buckeyes HAVE to untuck when crossing the border. Anybody, correct me if I'm mistaken.

Dan: according to what I found on PDO, in Michigan:dan_sayers wrote:Not only do you not have plain sight, but from what I've read, behind the wheel is one time when open carry is NOT legal. Meaning us buckeyes HAVE to untuck when crossing the border. Anybody, correct me if I'm mistaken.
28.425c
Sec. 5c.
(2) Subject to section 5o and except as otherwise provided by law, a license to carry a concealed pistol issued by the county concealed weapon licensing board authorizes the licensee to do all of the following:
(a) Carry a pistol concealed on or about his or her person anywhere in this state.
(b) Carry a pistol in a vehicle, whether concealed or not concealed, anywhere in this state.
It looks like you don't have to tuck or untuck, both are ok.

I open carry in my truck sometimes going in to work or on the way home. Usually, it's in the spring or fall when I don't have a cover garment. In fact, I've been chided by my son to "cover up" when I drop the kids off at school in the morning. Of course, I live in MI so that's perfectly legal.
Under Michigan statute, if a pistol is in a vehicle passenger compartment, it is considered concealed. That means you can open or concealed carry, tuck it under the seat, put it in the console or have it next to you. it doesn't matter. If you have a CPL (CHL), you can carry a pistol in a vehicle any way you like.

You know Brad, that's just plain wrong, and dangerous too! You don't have any state troopers (or police in general) left up there because of that policy, right?appliance brad wrote:Under Michigan statute... If you have a CPL (CHL), you can carry a pistol in a vehicle any way you like.
Certainly that's why Ohio has the policy we have - the few remaining MI troopers implored our legislature to do things differently here because they just didn't want their brother OH officers to suffer their fate.

Yes, I do believe in open carry. An openly armed man is clear in his intentions. Concealed carriers are sneaks and skulkers and elitist, boot licking, political contribution making, running dog lackies of The Man. <wink> (thx grumpycoconut - OpenCarry.org)

Yeah. Dag! Have you no concern at all for officer safety? (not to be confused with Officer Friendly...)BB62 wrote:You know Brad, that's just plain wrong, and dangerous too! Licensed concealed carry in a motor vehicle has led to the deaths of countless state troopers, I'm sure (and I do mean "countless"). I'd give you some examples, but there aren't any...

Every encounter I've had with law enforcement while carrying has been positive. I'll be the first to admit I have a heavy foot plus I drive about 33,000 miles per year. The odds are stacked against me. Just once have I even been asked where my pistol was. "Thank you" was the only comment my reply elicited.
It took a couple years for law enforcement to get used to citizens carrying all the time. Most departments are very, very good when it comes to CPL holders. Our permits are seen as "good citizen" cards. I'd sure like to get your silly "plain sight' provision fixed. I wish that businesses were not so willing to post. Hang in there guys and gals. I've heard it took about 5 years for the signs to go away in NC after shall issue passed.

What about in Michigan? Does the officer know you are carrying before he approaches your vehicle like in Ohio?
Americans need not fear the federal government because they enjoy the advantage of being armed, which you possess over the people of almost every other nation. . James Madison.

If the owner has a CPL, it comes up on the LEIN report. My truck is owned by my corporation so no, it does not. My wife's truck is a personal vehicle and since she has a CPL, it does report back as such.Jronjakoh wrote:What about in Michigan? You need to become familiar with this page:Grantraus wrote:Ohio and Michigan have reciprocity?...
http://www.ag.state.oh.us/le/prevention ... rocity.asp
and with the laws of Michigan.
I would start with www.packing.org
There are also other states, like IN, who recognize your Ohio license, but we do not recognize theirs.
IMHO your instructor was seriously remiss in not telling you such things/giving you direction to resources which you could peruse.

I just got back from my weekend trip to Michigan...carried as well. Once I was over the border into MI, I let out a sigh of relief. I looked around at the businesses and never saw a no guns sign. I love IN and MI for that alone..they give credit to us law abiding folks. Oh well, I just need to go out of state more often!!
