The interplay between specific regulatory authority granted to the Ohio Casino Control Commission and the overarching uniformity goal of ORC 9.68 could indeed make any legal challenge complex.djthomas wrote: ↑Sat Feb 28, 2015 10:21 pmOAC 3772-20-01 (D)JediSkipdogg wrote:I've heard it's required of the license, but if so, that wouldn't be 9.68 compliant. I have a feeling they are just posted because they can be.They claim that state law ORC 3772.03 gives them the authority to make the rule, so I think they'd argue that 9.68 doesn't apply. And in general, it is better to play on an online casino site and you will never be in trouble with the law. Challenging this in court might be a bit tricky because I'm inclined to think that only the casinos would have standing since the rule is carefully worded to direct the prohibition at the casino licensee not Bob the random citizen.(D) Except for the following persons, no casino operator licensee or applicant shall permit firearms at a casino facility, as defined in division (C) of section 3772.01 of the Revised Code:
(1) Commission gaming agents;
(2) Law enforcement officers, as defined in sections 9.88 , 109.71 and 2901.01 of the Revised Code, who are on duty and within their jurisdiction;
(3) Law enforcement officers who are hired by a casino operator licensee or applicant for special duty as long as the officers are not specifically involved in gaming related regulatory functions; and
(4) Security guard providers, as defined by section 4749.01 of the Revised Code, who:
(a) Are not employed by the casino operator licensee or applicant;
(b) Are licensed under section 4749.03 of the Revised Code;
(c) Meet the requirements in section 4749.10 of the Revised Code; and
(d) Work for and are on duty with an armored motor vehicle security service licensed under section 4749.03 of the Revised Code.

Re: Miami Valley Gaming
The problem is that the horse barn area is also marked "No Guns", so I am hauling very expensive horses up and down the road without protection, or at least I'm not supposed to.
