Enforcing Gun Control

Attorney General Bill Barr will announce a new Department of Justice initiative tomorrow called Project Guardian. Project Guardian, which will be implemented through ATF and overseen by DOJ, will focus on preventing "gun violence" in cities across the country.

Barr will make the announcement and detail the project Wednesday from downtown Memphis. He will be joined by ATF Acting Director Regina Lombardo, U.S. Attorney for the Western District of Tennessee D. Michael Dunavant and ATF Special Agent in Charge of the Nashville Field Division Marcus Watson.

In the meantime, President Trump's DOJ has been setting records for prosecutions against felony possession of firearms, against criminals carrying out crimes with firearms, illegal firearms sales and more.

In other words, instead of demanding additional gun control, DOJ is enforcing laws already on the books.
Very Angry?

Are we to cheer the enforcement of tens of thousands of tyranical, unconstitutional federal dictates?
Are we cheering NFA34 and GCA68? Is our faith in "Prohibited Person" prosecutions? Is that what RKBA is all about?

This seems a far cry from the promise to repeal Gun Free Zones, an unconstitutional restriction. Now we're going to hyper enforce these things?

IDK if these two stories are actually related, but they are in my sober mind...
But as a result, the ATF has sent out the letter below to both Powered By FFL/SOTs using Silencer Shop kiosks, and even some non-Powered By Silencer Shop FFL/SOTs.

Translation: the ATF issued Silencer Shop a variance authorizing the use of electronic signatures on their machines. Now, as a result of the DocuSign situation that affected a tiny fraction of the transactions Silencer Shop processes, the ATF is now requiring all FFL/SOTs that use the kiosks (over 650 around the country) to apply for their own individual variances.

TTAG spoke with Silencer Shop yesterday. They told us that they’re working directly with the ATF to resolve this and will be processing the variance letters for all of their Powered By dealers. The good news is that the dealers can continue using the current iteration of the variance through the end of this year, by which time all of the individual FFL/SOT variances should be in place.

Long story short, the inflexible ATF is causing a lot of headaches for (a few) buyers and a lot of dealers around the country because of a minor processing quirk that’s long since been fixed.

Project Guardian complements existing programs to enforce federal laws and facilitate close coordination with state, local and tribal partners and is based on five principles:

Coordinated prosecution: “Federal prosecutors and law enforcement will coordinate with state, local, and tribal law enforcement and prosecutors to consider potential federal prosecution for new cases involving a defendant who: (a) was arrested in possession of a firearm; (b) is believed to have used a firearm in committing a crime of violence or drug trafficking crime prosecutable in federal court; or (c) is suspected of actively committing violent crime(s) in the community on behalf of a criminal organization.”
Enforcement of federal firearms laws and background checks: “For all cases involving false statements on ATF Form 4473 (including lie-and-try, lie-and-buy, and straw purchasers), unlicensed firearms dealers, and other individuals involved in the illegal trafficking of firearms, the guidelines must place particular emphasis on: (a) violent persons, such as individuals convicted of violent felonies or misdemeanor crimes of domestic violence, individuals subject to protective orders, and individuals who are fugitives where the underlying offense is a felony or misdemeanor crime of domestic violence; (b) individuals suspected of involvement in criminal organizations or of providing firearms to criminal organizations; and ( c) individuals involved in repeat denials.”
Improved information sharing: “… on a regular basis, and as often as practicable given current technical limitations, ATF will provide to state law enforcement fusion centers a report listing individuals for whom NICS has issued denials, including the basis for the denial, so that our state and local law enforcement partners can take appropriate steps under their laws.”
Coordinated response to mental health denials: “United States Attorneys should consult with relevant district stakeholders, including ATF and state or local law enforcement and mental health departments, to assess the feasibility of adopting disruption and early engagement programs to address mental-health-prohibited individuals who, attempt to acquire a firearm and to counter the threat of mass shootings.”
Crime gun intelligence coordination: “Federal, state, local, and tribal prosecutors and law enforcement will work together to ensure effective use of ATF CGICs, and all related resources, to maximize the use of modern intelligence tools and technology, such as the National Integrated Ballistic Information Network (NIBIN) and Firearm Tracing, to investigate and prevent gun crime.”

What ultimately stopped the criminals in Loomis, Calif., from placing the stolen firearms into the hands of other criminals and being able to potentially carry out future violent crimes were the police. At a time when mistrust and misguided fear of firearms is so rampant in our society, we must place greater confidence in our police and security services—not treating them with suspicion, but giving them our total faith and support.

No new gun-control laws are needed to prevent gun crimes in our country. What is needed in America right now is increased support for our existing laws and for our law- enforcement officers who put their lives on the line to uphold them.
This seems to be the narrative going into the 2020 elections...ENFORCE THE LAWS! The above, I know this is a stunner, is an NRA article closing. The NRA/ NSSF /Barr DOJ is angling towards a crackdown. I seem to see this in many articles all of a sudden.

We're FOR this? We believe that anti-gun laws are going to keep us safer, if only we enforce them harder? Take a minute and think before you react...


Not to sound like a broken record, but we pro-RKBA types are now going to stand behind NFA34/GCA68 instead of effort-ing towards their repeal? Who is going to be caught up in this but people who buy and sell guns? People who are active in a once lawful hobby/sport?

When we started the Trump term, was this what anybody had in mind? I know we all like the 40-D time space continuum chess games, but, honestly, look at where we are.

AG Bill Barr supported portions of the Brady Bill, said he'd be OK with banning semiautomatic firearms and "high-capacity" magazines,and has said America needs to implement a "Red Flag" gun confiscation scheme. Which, he wrote one and submitted it to Congress. Bill Barr is not a friend of the 2nd Amd. Why are so many so called Pro-2A Org support these people and more of their authoritarian and totalitarian actions? With glee!

Barr wrote his own version of Red Flag Gun Confiscation orders and sent it to Congress. Supports the TAPS Act along Trump and Many Republicans.. Both Party is not for the 2A or the Nill Of Rights anymore unless it affects them.

INDIANAPOLIS – -(AmmoLand.com)- United States Attorney Josh J. Minkler announced that Iva Patrick, 30, of Indianapolis, was indicted by a grand jury for charges of unlawfully providing false information in connection with a purchase of a firearm.

“If you choose to lie on the federal forms when purchasing a firearm, you must face the consequences,” said Minkler. “Firearms purchased illegally, or for other people, are often purchased for no other reason, but to commit crimes. The Department of Justice and the U.S. Attorney’s Office is committed to reducing gun violence and enforcing federal firearm laws through Project Guardian.”

In July of 2019, investigators from the Indianapolis Crime Gun Intelligence Center (CGIC) initiated an investigation into the suspected firearms trafficking activities of Iva Patrick. Investigators were able to confirm that Patrick purchased at least 36 firearms from federal firearms licensees (FFLs) in the Indianapolis area on at least eight separate occasions between June 15, 2019 and August 9, 2019.

Patrick’s then boyfriend, Jeremy Evans, who is a convicted felon and the father of her three children, instructed Patrick to purchase all of the firearms. Evans was unable to purchase the firearms himself, due to numerous previous felony convictions, and he directed Patrick to purchase the guns for him. Patrick completed the required paperwork for each gun purchase, indicating that the guns were for her, when in fact the guns were being purchased for Evans.

Evans was present in the parking lot of the FFLs during several of the firearms purchases and he specifically told Patrick which firearms to purchase. Once Patrick secured the firearms purchases from the FFLs, the firearms were initially stored at an Indianapolis residence. On August 21, 2019, CGIC investigators executed a search warrant at the Indianapolis residence, where receipts for numerous firearms purchased by Patrick were located and numerous empty firearms boxes, including one firearms box belonging to one of the firearms purchased by Patrick were found. However, no actual firearms purchased by Patrick were recovered during the search at the Indianapolis residence.

MADISON, WIS. – -(AmmoLand.com)- Scott C. Blader, United States Attorney for the Western District of Wisconsin, announced that Travis Hicks, 24, Madison, Wisconsin, was sentenced today by Chief U.S. District Judge James D. Peterson to two years in federal prison for being a felon in possession of a firearm. Hicks pleaded guilty to this charge on October 9, 2019.

In 2013, Hicks was convicted of the felony crime of assault with a dangerous weapon. On October 4, 2018, Hicks was in Jackson, Michigan, with a friend and was shot at during a drive-by shooting. The friend returned fire and both fled the scene. Police arrested Hicks that day and found ammunition in his vehicle. Hicks was charged in state court in Michigan with being a felon in possession of ammunition and was released after posting bond on December 10, 2018. Hicks failed to appear at a hearing in the case on January 15, 2019, and a warrant was issued for his arrest.

At sentencing, Judge Peterson said that when dealing with gun crimes, protection of the public is always the first concern. Judge Peterson noted that Hicks associates with people who use firearms and expressed concern that an innocent bystander could be shot in an exchange of gunfire. Because of that, Judge Peterson found that Hicks posed a risk to the public.

The charge against Hicks was the result of an investigation conducted by the Madison Police Department and Bureau of Alcohol, Tobacco, Firearms and Explosives. The prosecution of the case has been handled by Assistant U.S. Attorney Corey Stephan.

This case has been brought as part of Project Safe Neighborhoods (PSN), the U.S. Justice Department’s program to reduce violent crime. The PSN approach emphasizes coordination between state and federal prosecutors and all levels of law enforcement to address gun crime, especially felons illegally possessing firearms and ammunition, and violent crimes and drug crimes that involve the use of firearms.

As far as I've read, the Silencer Shop issue is not related to anything else in this thread. It was a systems / processing / administrative issue at the agency level, not an enforcement action aimed at restricting suppressors.

That was my understanding of it in the beginning.
I believe it has to do with the signature requirements on the Form 4.
