Lesser Magistrate Declares Defiance of recently passed vote

Post by bignflnut »

Republic Police Chief Loren Culp, appearing on Fox News over the weekend, explained his recent declaration that recently-passed gun control Initiative 1639 will not be enforced in his jurisdiction so long as he remains on the job. The anti-gun measure, adopted by a 60-40 vote margin, prohibits young adults from legally purchasing and owning a so-called “semiautomatic assault rifle.” It also requires so-called “enhanced background checks,” mandatory training, registration, so-called “secure storage,” and creates a new crime called “community endangerment.”

The initiative campaign was largely funded by less than a dozen wealthy elitists living in the Seattle area, trying—according to critics—to push their personal lifestyle and morals down the throats of all Evergreen State residents.

I-1639 was definitely the hot topic at the Washington Arms Collectors’ weekend gun show at the Puyallup fairgrounds. Thousands of people jammed the gun show Saturday and again Sunday. They stopped at the Second Amendment Foundation’s table looking for information on what’s next. A federal lawsuit challenging parts of the measure was filed last week by SAF and the National Rifle Association.
He cites the State Constitution and his oath to its fidelity.
God Bless Culp! We need thousands like him!
The Doctrine of the Lesser Magistrate holds that Culp has the moral and legal justification to uphold his oath. He is performing his solemn and sworn duty to the citizens by upholding their Rights, even as they attempt to vote them away from their fellow man. Rights cannot be voted away, surrendered or in any way separated from humans.
In short it is the greatest absurdity to suppose it in the power of one or any number of men at the entering into society, to renounce their essential natural rights, or the means of preserving those rights when the great end of civil government from the very nature of its institution is for the support, protection and defence of those very rights: the principal of which as is before observed, are life liberty and property. If men through fear, fraud or mistake, should in terms renounce and give up any essential natural right, the eternal law of reason and the great end of society, would absolutely vacate such renunciation; the right to freedom being the gift of God Almighty, it is not in the power of Man to alienate this gift, and voluntarily become a slave--- (Emphasis per original.)

Let's use this story to be The Positive People®!

This is the kind of story that can be discussed among the young-ins at Thanksgiving. Courage, honor, standing up for those who can't fight city hall on their own...these qualities of heroism appeal to male and female alike, not to mention the Liberty and Freedom of the People!

Upholding a standard of justice that we can teach and enjoy for generations to come! A standard of justice that can propel a society to prosperous times!

This guy isn't hitting the airwaves for his own political gain. He's a humble servant in his own jurisdiction standing tall and insisting on upholding his oath! What would be better to discuss amongst family?

If we lived there, how could our family support this hero? How could we encourage others to follow this example? How do we get this concept to spread across county lines?

The state of Washington is similar to the United States in general. The vast majority of the population lives in a few large cities, distant from the rural and small-town folks in a lot more than just mileage. The left-leaning cities are in direct opposition to the more right-leaning rural communities, but the rural communities are under the thumb of the city voters due to numbers.

Back when they voted on I-1639, 27 of the 39 counties were against the measure, but because the twelve counties that voted FOR it were more populous, the initiative passed.

SNIP

Now the state is divided because the counties that voted against the measure are refusing to be governed by unconstitutional laws to which they objected in the first place

And they’re supported by their sheriffs.
Some Washington law enforcement officers are refusing to enforce these laws.

Klickitat County Sheriff, Bob Songer, Republic police chief Loren Culp, and Ferry County Sheriff Ray Maycumber are among those who have publicly vowed not to enforce the new unconstitutional gun laws.

If CA can be a sanctuary state and give drivers licenses to illegal immigrants, then surely this sort of sanctuary movement should be fully ok too.

This kind of situation is exactly what would happen if the Democrats would push to do away with the Electoral College and all elections would be by the popular vote. The east and west coast populations would be telling the less populated mid-west what they can and can't do. Forcing their liberal laws upon the conservative few.

Multiple states have defied the feds regarding a common weed.

NY Governor Cuomo, prior to lighting World Trade Tower's spire in pink justified legislation by arguing for State's Rights.

As SCOTUS undoubtedly shifts, and the antis seemingly lose the National Goalie, guess who is going to be all for State autonomy against a federal system? They know that the Swamp things won't defund any States. The pensions and the obligations of almost all states make them bankrupt on paper as it is.

The image of the results of the presidential election by county was pretty telling. How hard is it to pick out the liberal enclaves in each state using this map..

As soon as I see billionaires and big money out of state interest groups pushing a bill, I know there is something wrong with that bill and we don't want it.

I'll go out on a limb and project that the 2020 map will be more blue (sadly). But I've been known to cut the limb behind me before.

I did an analysis shortly after the election. Hillary won NY, Los Angeles and Chicago by something like 7-10 million votes. The rest of the country, other liberal enclaves included, voted overwhelmingly for Trump. Hillary took something unreal like 90% of those media cities. Which is the EXACT REASON for the electoral college.

Which is exactly why all the libs are now shrieking about doing away with the Electoral College.

If the Dems lose the WH again in '20, look for that effort to be ramped up.

Spokane County Sheriff Ozzie Knezovich said he refused to enforce Washington State's latest gun control law, I-1639. According to the Sheriff's office, a person called into Crime Stoppers to report a threat made on Facebook.

"Sheriff Knezovich is going to get a bullet in his skull," the post allegedly read. The caller also said he'd shoot anyone who disagrees with I-1639.

When investigators looked into the person's Facebook account, the user also commented on a news story about Grant County Sheriff Tom Jones refusing to enforce the new law. The person commented on the news story saying, "I am going to kill every single one of them," referring to Republicans.

IDK, but it gives the article a homey feel.

Washington Attorney General Bob Ferguson on Tuesday called out sheriffs and police chiefs who have publicly said they won’t enforce Initiative 1639, saying they should follow the new gun law because it is the “will of the people” and because their inaction could cost taxpayers.

SNIP

In his letter posted Tuesday, Ferguson said he doesn’t agree with nearly all of those sheriffs, including Spokane County Sheriff Ozzie Knezovich, who believe the law is unconstitutional as written.

“If you personally disagree with Initiative 1639, seek to change it. But do not substitute your personal views over that of the people,” Ferguson wrote. “As public officers, our duty is to abide by the will of the people we serve, and implement and enforce the laws they adopt. I encourage you to do so.”
So, if the people overwhelmingly voted to lynch a public official, say a governor or Attorney General, would this still be true? Maybe, and I'm just spitballing here, the American Philosophy holds that individuals have Rights which can't be violated by the majority. Perhaps this is a central tenant of Liberty?
In his letter, Ferguson said any sheriffs who refuse to do the checks could put their constituents at financial risk or worse.

“However, in the event a police chief or sheriff refuses to perform the background check required by Initiative 1639, they could be held liable if there is a sale or transfer of a firearm to a dangerous individual prohibited from possessing a firearm and that individual uses that firearm to do harm,” Ferguson wrote. “In short, the taxpayers of your city or county assume the financial risk of your decision to impose your personal views over the law.”
Like FINANCIAL concerns are going to sway them, or have ever been a thing with no-knock raids, police training, etc...
“Like all laws passed by the people of Washington and their representatives, Initiative 1639 is presumed constitutional,” Ferguson wrote in part. “And, I am confident we will defeat any constitutional challenge to Initiative 1639 as well.”
Presumed constitutional? Like, the judicial system has a bias towards these measures, regardless of their content? Huh?

From the Department of the Tolerant:
As reported by The Daily Wire’s Ashe Schow:

[Jaydin] also posted multiple death threats against cops after members of the police force publicly denounced a recently passed gun control bill (I-1639) which expands background checks and prohibits anyone under 21 from buying a semi-automatic rifle, among other things. The National Rifle Association has already filed a lawsuit against the law.

Incredibly (and stupidly), Jaydin wrote this:

heriffs that are non compliant will be shot. By me.”

Another post:

“I really want to kill a police officer.”

Therefore, on February 20th, the Okanogan County Sheriff’s Department took Jaydin into custody. He was charged with harassment and then turned over to federal custody.

A growing number of sheriffs, almost all in rural counties, have publicly stated that they will not, or believe they cannot, enforce the provisions of I1639, a ballot measure passed by popular vote last November which aims to restrict access to and use of assault weapons.

Their positions – outlined in written statements, local media reports, and Facebook posts – occupy varying points on a spectrum of resistance.

A few, like the Klickitat county sheriff, Bob Songer, say that they would not only not enforce the laws, but would consider preventing other agencies from doing so in their counties.

Others, like Sheriff Brad Thurman in Cowlitz county, have cited a continuing legal challenge from the National Rifle Association and the Second Amendment Foundation as evidence that the laws may not be constitutional, and are proposing to hold off enforcement until that case is resolved.

Another group, including the Spokane county sheriff, Ozzie Knezovich, have argued that the law as it stands is so vague that there is “nothing to enforce”.

But all of these positions add up to a refusal to enforce I1639 in the form in which it was passed by Washington voters.

Only four county sheriffs so far have publicly committed to enforcing the laws.

According to a Police One story, Maryland’s House Bill 786 “would regulate shotguns and hunting rifles similarly to handguns.” In other words, a license will be needed for owning a long gun. Additionally, all long gun sales and purchases would be subject to universal gun registration. Although HB 786 does not call for full-blown gun confiscation, “it does allow the Department of State Police to create regulations to carry out the law.”

Sheriff Lewis reiterated his commitment to refusing to enforce HB 786 and said that he “will stand up against it” should it become law.

What’s happening in Maryland is very similar to how New Mexico sheriffs are confronting gun control bills in the state legislature. States like Oregon have also spearheaded “Second Amendment Preservation Ordinances” to counter statewide attempts to enforce draconian gun control.

This appears to be the go-to strategy for gun owners living in rabidly anti-gun states. These states tend to be dominated by massive urban centers whose elected officials have no clue how life operates outside of the urban bubble.
Thank God for these Sheriffs. We pray this trend continues...
