Chief Justice John Roberts said in the courtroom Monday that Ginsburg would participate in deciding the argued cases “on the basis of the briefs and transcripts of oral arguments.”
HUH?

Now we're telecommuting SCOTUS?
Anyone want to talk about the credibility of SCOTUS now? Anyone, Anyone?

What about open public trials? Will Kagen now be reading questions to lawyers from Notorious RBG?

Regarding RBG what is this credibility you speak of? Does she even need to read the oral arguments anyway? What questions would she need to ask? I've never seen any SCOTUS cases where it wasn't obvious what her decision was going to be, even before the cases arrived there.

Justice Ruth Bader Ginsburg was absent from the Supreme Court bench for the second day in a row on Tuesday.

Chief Justice John Roberts noted Ginsburg’s absence when the justices took their seats for the second time in the new year.

Repeating what he said Monday, Roberts said Ginsburg is “unable to be present” for the court’s sitting, but will participate in the decisions using transcripts of the arguments and court briefs.

When you're right, you're right, bignflnut. Downtown at the cigar shop today I spoke with two lawyers who litigate in the federal system regularly. Neither knows of a precedent for the SCOTUS ever operating in this manner, not even once. Both were highly dubious of the legality.

Does anyone remember the hue and cry from the non-right wingers when Kavanaugh was confirmed, by people even ON THAT BENCH, that the legitimacy of SCOTUS would be questioned!??

Sotomayor echoed Kagan’s concern.

“We have to rise above partisanship and our personal relationships,” she said of the eight justices. “We have to treat each other with respect and dignity and a sense of amicability that the rest of the world doesn’t often share.”
And Roberts, Mr. Obamacare himself, is allowing this injustice!??

The White House has been reaching out to political allies and conservative activist groups to discuss preparations for an ailing Supreme Court Justice Ruth Bader Ginsburg's possible death or departure from the bench, according to Politico.

Supreme CourtJustice Ruth Bader Ginsburg will be absent from oral arguments at the high court again next week continue to work from home next week as she recuperates from cancer surgery in December. She missed oral arguments for the first time in more than 25 years last week.

Ginsburg's recovery is "on track," according to the Supreme Court. She underwent surgery on Dec. 21 to remove two cancerous growths from her left lung. As was the case last week, she'll participate in the "consideration and decision of the cases on the basis of the briefs and the transcripts of oral arguments," Supreme Court spokeswoman Kathy Arberg said in an emailed statement. "Post-surgery evaluation indicates no evidence of remaining disease, and no further treatment is required," Arberg said.

Now that Republicans have 53 Senators, Collins and Murkowski can’t hold up a nominee. Which gives Trump more leeway.
Somebody there knows that Romney and Rubio are in the Senate, right?

It's funny to hear people say that there are x number of Republicans in a Senate. The number is always much less.

How does another confirmation hearing get underway without hourly riots in DC?
