You’ve probably seen, and maybe used, Tannerite, a binary explosive that’s permissible to use in reasonable quantities and with reasonable safety precautions. It’s not a terribly high explosive, but it’s not trivial either: it’s based on ammonium nitrate, like many of the things terrorist bomb-makers like to use, and it’s shock-sensitive, so it can be set off with a hit from a bullet. Those two in combination should make you respect it, at least. And as this video shows, when you add unreasonable quantities (3 lb. packed in a sheet-steel lawnmower) and unreasonable distances (a foot over 14 yards, by police measurement), you’d be lucky to escape, like this young man, David Pressley, did, with a Life Flight ride and a lifelong disability.

Doesn't matter if it is for sale, many things can be sold that cannot be used legally. As soon as you combine the two parts, it becomes an explosive and is regulated in Ohio as such. The way I read it, you have to have a license to use it legally in Ohio, but it appears that most LEO are not too worried about enforcing it.

Yep. That was my understanding. Just wanted to check to see if anything had changed.

Also my understanding that the only reason it is regulated is because of a unilateral decision by State Fire Marshal and some creative reading of the statutes.

Not sure about the creative part, ORC 2923.17 (A) says “No person shall knowingly acquire, have, carry, or use any dangerous ordnance.”
ORC 2923.11 (K) then defines dangerous ordnance as follows:

(K) "Dangerous ordnance" means any of the following, except as provided in division (L) of this section:

...

(3) Nitroglycerin, nitrocellulose, nitrostarch, PETN, cyclonite, TNT, picric acid, and other high explosives; amatol, tritonal, tetrytol, pentolite, pecretol, cyclotol, and other high explosive compositions; plastic explosives; dynamite, blasting gelatin, gelatin dynamite, sensitized ammonium nitrate, liquid-oxygen blasting explosives, blasting powder, and other blasting agents; and any other explosive substance having sufficient brisance or power to be particularly suitable for use as a military explosive, or for use in mining, quarrying, excavating, or demolitions;
...

And since Tannerite is a binary explosive created by mixing ammonium nitrate and aluminum powder, when combined you've made "sensitized ammonium nitrate". Now, there may be something in the ORC I'm not aware of which would change that, but other than the licensing provision in 2923.17 I don't see anything that would make it legal for possession (once mixed) or use in Ohio.

Couldn't remember what the controversy was when the SFM put out his letter saying that it was illegal. Maybe it was just that ORC called out the sensitized ammonium nitrate (Tannerite) where Federal law doesn't. There was a thread around here somewhere on it.

Yup, I see / hear it often enough myself. As I mentioned above, many (most?) sheriffs and other law enforcement aren't likely to do anything unless you do something stupid or the neighbors call them on you. I suspect few LEO are even aware that it is covered under the ORC. Like rouger10 said, it's for sale at most sporting goods stores, why would people, including LEOs, think it wasn't legal to use?

Fireworks are legal to buy but illegal to use in Ohio too.
