West Virginia introduced a bill that would allow deadly force to be used against law enforcement officers who enter a home unannounced.

What do you guys think about this? I think it's great news. Hopefully, this will make the police rethink their actions, and prevent more innocents from getting killed. I remember many news articles of wrong house scenarios, completely unannounced search warrants, and people dying from not knowing what the hell was happening at 4:00 AM.

Hasn't the US supreme court already approved no-knock entry?
Wouldn't this bill/law be overridden by their ruling?

I don't believe it was "approved" so much as it was not found unconstitutional. That being said, the states are free to enact additional protections for their citizens under their own constitutions.

Additionally, even in an "unannounced" entry, the police still yell "police" before busting down the door. If that's the case in most WV "no-knock" entries, I don't know how much of a fix it would be.

This sounds like "feel good" legislation. Police whisper "police" and knock down the door. Homeowner pulls a gun and is shot dead. Police say "we announced" and there is no proof that they didn't.

If they want to improve things, we need to stop the door busting in 99% of the situations. It is needed for hostage rescue, but beyond that I do not believe it is justified or right.

Fantastic! I hope this spreads to Ohio!
I just can't justify breaking in some one's house at 3am , on the word of an informant(who is usually a drug addict). Too many innocent citizens have been murdered by LEO's because of these no-knock warrents. :(

I wonder how the LEO worshipers on this forum will spin this. :roll:

Is police entering peoples homes unannounced actually a problem? I have not herd any real complaints. Why solve a problem that does not exist?

A few weeks ago there was a 92 year old woman killed in Georgia during a no-knock warrant raid. She did manage to wound a couple of the cops. She was innocent of any wrongdoing.

A month or so earlier there was another similar fatality.

A lot of us think that yes, there is a problem that needs solving. You don't see it that way?

The proposed legislation is being misconstrued a bit, I think.

The intent is to prevent homeowners that honestly believe they are being invaded from being held liable in the death of a policeman.

The intent is not to provide a way to kill a person because they don't announce. If the homeowner knows those entering are legitimate cops, the homeowner is not protected.

We need to be careful how we phrase castle doctrine legislation.
