Man confronts burglar initially inside his car

Post by M-Quigley »

In this news story at the bottom, someone is (IHO) making comments about how this shooting is somehow not justified under Texas law, as it doesn't meet the 3 elements for protecting property with lethal force. If the guy had merely gotten out of the car and run off, even with a cheap item inside the car, that might be true, IDK. If however the facts are as the homeowner claims, the guy in the car got out, approached the homeowner and got into an altercation, possibly in an attempt to take the homeowners gun. At that point it was the burglar assaulting the homeowner, and the homeowner should be allowed to defend himself against a potentially lethal attack, IMHO. I'm not a lawyer though, not even in Texas.

I think where it might get complicated for the home owner is that he went outside instead of stying safely inside his home, and ordered the guy out of his car at gunpoint. This is where things got escalated quickly. Will be interesting to watch how this unfolds
