Perry was making extra money by driving for a ride-sharing service at the time. After dropping off a fare, he turned onto a street that was being blocked by what was ostensibly a protest. When he attempted to make his way through, people surrounded his car, beating on it. That’s when Garrett Foster approached him with an AK-variant rifle, pointed it at him, and demanded the window be rolled down. At that point, Perry feared for his life and discharged his firearm in what he felt was self-defense.

There is video that shows the scene, confirming that the car was, in fact, mobbed.

Because this is Austin, TX we are dealing with, Perry has now been charged with murder, indicted by a grand jury seated by a rabidly political district attorney.

Austin has always been a liberal stronghold. Back in the 70's there was a nude beach there that I, unfortunately, never got around to visiting. It does have good restaurants and the WWII Museum is fantastic, but, for the last several years, it has not been a place that I felt comfortable visiting.

This is probably a case that has a good chance on appeal, but as far as a jury trial is concerned, remember that Austin's motto is "Keep Austin weird!"

Unfortunately, assuming it is overturned eventually, unless he has donations to cover his legal fees, it will likely bankrupt him. He would be facing a dishonorable discharge in addition to having his life upended. All in an attempt to appease the mob, and a prosecutor who is politically motivated.

Any sane person would almost certainly shoot in the same circumstances. Ask any LEO what they would do if any gun was pointed at them; especially an AK-47 pointed directly at their head.
