I believe you're allowed to buy a firearm as a gift.

Yes you are. However, you giving the money to someone else to have them buy you the firearm isn't a gift...EricTheBald wrote:I believe you're allowed to buy a firearm as a gift.

Why wouldn't that person just buy the firearm for themself? What are they trying to hide?</Devil's Advocate>Klingon00 wrote:Why should it ever be illegal to purchase a firearm for someone who is legally allowed to possess it?JustaShooter wrote: A straw purchase does not need to involve a prohibited person.

Re: Kenosha
in this case the person that provided the money was a minor and not legally allowed to purchase it themselves... That's why I said it appeared to be a straw purchase. Purchaser would have also had to check the box on the 4473 that they were the buyer and it wasn't for anyone else.. although we know the ATF doesn't prosecute very many people for lying on the form.JustaShooter wrote:Why wouldn't that person just buy the firearm for themself? I was actually surprised that wasn't one of the initial, charges, but maybe that would have to be a federal charge and not local ?
ultimately I'm not too disappointed in the outcome.

Re: Kenosha
Interesting question. Can you be allowed to possess a gun but not allowed to purchase it?
As to the delinquency of a minor charge being predicated on possibly leading a juvenile to delinquent behavior you can almost pick your target and charge them.

God,
Grant me the serenity to accept the things I cannot change,
the courage to change the things I can
and the Wisdom to know the difference.
Carrying a gun is a right, not a crime.
Gun control is racist.

Remember when Ohio changed the Concealed Carry law to allow military members under the age of 21 to obtain a license, but did not change the law making it illegal for them to buy a handgun or for someone to give them one?catfish86 wrote:Interesting question.
