The officer said he talked to the man, Spencer, who had slurred speech, smelled of alcohol and had blood-shot eyes, the report states.

Spencer denied driving the car.

“Spencer was intoxicated to the point that he did not know where he was or how he got to the location we were at,” the report states.

During a pat-down, another officer found a loaded Glock in Spencer’s pants. The officer said the gun was in his pant leg, appeared to have slid down and was not secured in a holster.

Police contacted Spencer’s wife, who picked him up from the scene. Spencer told one of the Beavercreek officers he was a Dayton police officer. A police ID card was found in his wallet.

Police said the Greene County Sheriff’s Office received a report at about 1:10 a.m. about an intoxicated driver traveling on U.S. 35 whose vehicle seemed to match Spencer’s, the report states.

Spencer faces a first-degree misdemeanor charge of using a weapon while intoxicated and a minor misdemeanor charge of disorderly conduct.

Beavercreek is a hotspot for ugly gun stories.

Looks the big blue wall didn't stand up there. Sounds like he's being treated the same a law bidding citizen who made a mistake...

Except that they had probable cause for F4 improper handling because they saw him get into the running vehicle and the handgun was concealed on his person.

A summons in lieu of a warrant (SLW) is an option for misdemeanors. Whether that's the norm for M1s involving weapons in Beavercreek I have no idea.
