On the positive side the suspect was not hit and it did convince him to leave the car after that. :roll:

Butler Twp. Police Chief John M. Porter said that Russell D. Higgins III, 19, was seen driving his dark gray 2012 Dodge Charger in a reckless manner in the area of Benchwood Road and North Dixie Drive, according to a news release.

An officer tried to stop Higgins, but he allegedly eluded the officer before stopping his vehicle in the Petland lot.

All of the vehicle’s windows were blacked out so the officer could not see the driver, the release stated.

The officer gave multiple commands for the driver to shut off the vehicle and roll down his window, when the officer drew his service weapon and repeated his commands to the driver.
The article doesn't say whether he approached the vehicle at all or if he did at what point did he draw his service weapon, which if the allegations are correct probably would not have been a safe thing to do whether a gun drawn or not. I can certainly understand the officer having his gun drawn in these alleged circumstances. Having the firearm unintentially discharge is another matter.

Update: dash cam video of ND, along with explanation of how the ND happened. The online video appears to be edited and not the one shown on the TV news. On the TV news the video shows the driver partially opening the door then shutting it. The driver only opens the door all the way after the round strikes the window. According to the TV news the driver allegedly had a warning issued for the window tint prior to this stop.

The accidental gunshot happened when the officer transferred his gun from one hand to another to answer a dispatcher on the radio, Porter said

Prior to the shot fired, Higgins ignored repeated orders by the officer to step out of the vehicle, which Porter said was covered by very dark, and illegal, window tint.

The driver cracked the door an inch or two for a second then slammed it shut again.

Moments later, you see the gunshot from off-screen and a puff of smoke at the driver’s side window.

Higgins was not hit. He stepped out of the car and was detained.
