And I also take an oath of office that says, I'll support the U.S. Constitution, the Constitution of the state of Colorado and then, I'll enforce the laws of the state of Colorado. When those things are in conflict you know you have to decide which one you are going to adhere to.

Scott Pelley: Are you prepared to get locked up in your own jail?

Steve Reams: That is something that could happen. A judge could order me to my own jail. You know, I would be the one litigating that issue and we'll determine at that point if this Red Flag law is constitutional.

The clash in Virginia over gun control has reached a new level, with proponents of a gun “sanctuary” movement urging active resistance to Democratic proposals in Richmond, citing the arguments that led to the American Revolution.

“Resistance to illegal and unauthorized government acts is not new,” said two leaders of the movement in noting the decisions by the Founding Fathers to sign the Declaration of Independence that challenged Great Britain and King George III.

This doctrine is, in fact, foundational to our form of government. Indeed, the Declaration of Independence is a document of interposition, between the American colonists and a tyrannical King George III. Its signatories — the people’s representatives — pledged to one another ‘our Lives, our Fortunes and our sacred Honor,’ believing that they most likely would be tried and executed for treason against the crown,” said the new memo from the Virginia Citizens Defense League and the Virginia-based Gun Owners of America Inc.

Their 12-page memo was both in defense of the state gun sanctuary movement that has been adopted by 114 counties and communities and a challenge to the opinion of Virginia Attorney General Mark Herring that the sanctuaries have “no legal effect.”

Second Amendment Sanctuary Ordinances (SASOs) refer to ordinances adopted by some jurisdictions in the United States to prevent the enforcement of certain gun control measures that violate the Second Amendment. The ordinances typically prevent the expenditure of funds for various gun control proposals, such as emergency protection orders, enforcement of gun background checks, and red flag laws.

As of 1/07/2020, over 418 counties, cities, and towns have passed SASOs or sanctuary resolutions in 21 separate states. Illinois, Colorado, New Mexico, Washington, and more recently Virginia, have passed them in a majority of their counties. This number does not include Alaska, Idaho, Kansas, and Wyoming, all of which have similar state-level protections.

That State Up North:
Earlier this month, Lapeer County joined a growing group of Michigan municipalities signaling opposition to gun control legislation by voting to adopt a “sanctuary county” resolution. Also on the list of those adopting such resolutions are Mackinac, Cheboygan, Otsego, Presque Isle, Oscoda, Kalkaska and Osceola counties.

Many more are considering resolutions. Ionia County will hold a vote tonight, Tuesday, Feb. 11. Bay County will also vote tonight, but to adopt a resolution signaling support for constitutional rights in general.

Jackson County will likely vote on a proposal at its Tuesday, Feb. 18 meeting. Berrien County is considering a resolution. Macomb County has a resolution in the works, according to the Detroit Free Press, and The Livingston Daily reports Livingston County may consider a resolution as well.

The Cadillac News reports resolutions are in the works in Wexford and Missaukee counties, as well as the City of Manton. Michigan Radio reports the “issue has come up” in Oakland, Newaygo, Schoolcraft and Emmett counties as well.

St. Clair and Alcona counties adopted resolutions affirming their support for Second Amendment rights, but stopped short of calling themselves ‘sanctuaries,' a position Sanilac County is also considering later this month, the Port Huron Times Herald reports.
State Rep. Gary Eisen (R-St. Clair Twp.) has introduced several resolutions to protect Second Amendment rights, both at the state and local level.

They include House Resolution 219 which would declare Michigan a sanctuary state and “fully affirm its support of the rights ensured and protected by the constitutions of the United States and Michigan, including the rights of law-abiding citizens to keep and bear arms.”

The sanctuary state resolution was introduced Jan. 21 and wasn’t on the Tuesday House Judiciary Committee agenda, but Eisen referred to it anyway. The measure was instead referred to the House Committee on Government Operations.

The resolution expresses concern about legislation in the Michigan Legislature and Congress that supporters say would infringe on gun rights. It urges federal and state agencies to preserve the right to bear arms.

Copies of the resolution would be sent to the president of the U.S. Senate, Vice President Mike Pence, U.S. House Speaker Nancy Pelosi (D-Calif.) and all Michigan U.S. Senate and House members.

There’s a growing national movement to establish Second Amendment sanctuaries, with Virginia as the epicenter, as the Advance previously reported. Lapeer, Mackinac, Cheboygan, Otsego, Presque Isle, Oscoda, Kalkaska and Osceola counties have adopted resolutions, Mlive reported. Other counties, including Monroe, Ionia, Berrien, Macomb, Livingston and Jackson, are considering measures.

Frustrated by liberal policies, some Oregon residents petitioned to leave the state – by moving the border with Idaho westward.

The movement secured initial approval from two counties and aims to get enough signatures to put the proposal on ballots in November, according to the group called Greater Idaho.

If the group succeeds, voters in southeast Oregon may see a question on whether their county should become part of Idaho by redrawing the border.

“Rural counties have become increasingly outraged by laws coming out of the Oregon Legislature that threaten our livelihoods, our industries, our wallet, our gun rights, and our values,” Mike McCarter, one of the chief petitioners, said in a news release. “We tried voting those legislators out, but rural Oregon is outnumbered and our voices are now ignored. This is our last resort.”

You’ve got Oregonians seeking to cascade into Idaho, Virginians who identify as West Virginians, Illinoians fighting to escape Chicago, Californians dreaming of starting a 51st state, and New Yorkers who think three states are better than one.

Separation fever is sweeping the nation as quixotic but tenacious bands of frustrated rural dwellers, suburbanites and conservatives seek to break free from states with legislatures increasingly controlled by liberal big cities and metropolitan strongholds.

On Feb. 3, the Newton County, Missouri, Commission passed a bill that will not only block federal enforcement of unconstitutional gun policies, but criminalize their implantation thereof within the jurisdiction of the county. The "Second Amendment Preservation Act of Newton County Missouri" declares that "all federal acts, laws, orders, rules, and regulations passed by the federal government and specifically any Presidential Administration whether past, present, or future, which infringe on the people's right to keep and bear arms as guaranteed by the Second Amendment of the United States Constitution and Article I, Section 23 of the Missouri Constitution shall be invalid in the county."

A new Missouri law banning police from enforcing federal gun rules has some law enforcement agencies pulling officers off federal task forces and others trying to figure out what is allowed.

Emails obtained by The Kansas City Star show that federal prosecutors in the eastern part of the state have asked at least a dozen police departments whether they will stop participating in federal gun crime investigations. The FBI has also queried a southwest Missouri police department and is assessing the responses of local police statewide.

At least two departments have pulled officers from assignments with the Bureau of Alcohol, Tobacco, Firearms and Explosives, spokesmen confirmed. And the Missouri Highway Patrol has suspended its participation in an ATF task force, to which one trooper was assigned full time and three part time, Lt. Eric Brown said.

“With the passage of HB 85, Patrol members can continue to serve on federal task forces except where the task force’s primary focus is on weapons violations,” Brown said.

The new law declares many federal gun regulations invalid in Missouri, including those covering weapons registration, tracking and possession of firearms by some domestic violence offenders.
