SB 215, Permit-less Carry and more

Senator Dr. Terry Johnson spoke to us at the PITP about his bill, SB 215; his speech can be seen here:

The bill is in the Senate Veterans and Public Safety Committee, chaired by our friend Senator Frank Hoagland.
Although we aren't advertising the bill loudly, we want to make you aware that the Statehouse team is and has been working with the sponsor to finalize the language.

There is a problem with S.B. 215.

Lines 126 through 130 define a “qualifying adult” for the purposes of being able to carry a concealed handgun without a license as a person over 21 “who is not legally prohibited from possessing or receiving a firearm under 18 U.S.C. 922(g)(1) to (9).”

But lines 201 through 217 provide that any person “comes within any category of persons specified in 18 U.S.C. 922(g)(1) to (9)” loses their right to carry a concealed handgun without a license.

Whoever wrote these provisions either has a fundamental misunderstanding of firearms laws or is planting a poison pill.

Coming within a category of persons specified in 18 U.S.C. 922(g)(1) is something different than someone who is prohibited from possessing a firearm under 18 U.S.C. 922(g)(1).

18 U.S.C. 922(g)(1) lists category of persons who are federally prohibited from possessing firearms, but 18 U.S.C. 921(A)(20) provides that the prohibitions outlined in 18 U.S.C. 922 to not apply to persons who have had their firearms rights properly restored by the state of conviction. See U.S. v. Cassidy (6th Cir. 1990), 899 F.2d 543.

Sb 215’s language in lines 201 through 217 does not take into consideration firearms rights that have been restored, and therefore, it could invalidate all Ohio restorations granted through pardon, expungement, records sealing, and court ordered restorations pursuant to R.C. 2923.14. See Caron v. U.S. (1998), 524 U.S. 308.

There is an easy fix: Strike “comes within any category of persons specified in” from lines 202-203 and replace it with “becomes prohibited from possessing or receiving a firearm under 18 U.S.C. 922(g)(1) to (9).”

Last night I forgot to mention all of the automatic restorations of firearm restorations in Ohio for non-violent felonies such as bouncing a check, not feeding your cat and being at a church conducting unlicensed bingo. Those people come within a "category of persons specified in 18 U.S.C. 922(g)(1) to (9)” who are NOT prohibited from possessing firearms pursuant to 18 U.S.C. 922(g)(1) to (9). And because Ohio would therefore restrict an aspect of some people's restored firearm rights, the all or nothing standard of Caron v. U.S. (1998), 524 U.S. 308, could again be imposed upon Ohio by the federal courts.

In short, SB 215 accomplishes what HB 203 would have back in 2011 before we were able to stop it.

It should be noted that Terry Johnson was also the primary sponsor of HB 203 in 2013. And it was 2013-2014 legislative session. Interesting to note that the poison pill in SB 215 is in line 203.

The House and Senate have passed bills, :) Next they are reconciled ??
