HB 243 - OH Knife pre-emption

Post by Bruenor »

Logical next step
The first hearing on Knife Rights’ Ohio Knife Law Preemption bill, HB 243, was held today. The Government Oversight Committee sponsor's hearing is the first of three hearings to be held on this bill. Sponsor Representative Al Cutrona introduced the bill and answered questions from committee members. Knife Rights Director of Legislative Affairs, Todd Rathner, had been in Ohio the week prior lobbying for this bill and its companion Senate bill, SB 156.

This bill follows enactment on April 12th of Knife Rights’ Ohio Knife Law Reform bill, SB 140. Without knife law preemption making those reforms applicable statewide, numerous cities and towns in Ohio are still able to ban many knives that are perfectly legal under Ohio’s statutes.

COLUMBUS, Ohio — Ohioans can now secretly carry knives under a new law that took effect Monday.

Prior law prohibited anyone in the state from carrying a concealed “deadly weapon” other than a handgun. House Bill 140 codifies into the law that knives, razors, or cutting instruments not used as a weapon do not count as a “deadly weapon.”

Similarly, the new law allows for the manufacturing, sale and possession of brass knuckles, cestuses, billy clubs, blackjacks, sandbags, switchblade knives, springblade knives, gravity knives, and similar weapons.

The bill passed on a nearly unanimous vote in the Senate (one Democrat opposed) and roughly on party lines in the House where five Democrats joined all Republicans voting in favor.

“This is a great day for Ohioans who no longer have to worry that they might be arrested under a dangerously vague state law for carrying a common tool, their pocket-knife, concealed in their pocket,” said Doug Ritter, an advocate and founder of Knife Rights, an advocacy group.

A powerful state law preempts cities or municipalities from imposing any gun restrictions on Ohioans beyond state and federal law. However, no such law exists for knives.

Six House Republicans have introduced a knife pre-emption law. To date, the bill has not yet received a committee hearing.

Last week, a “stand your ground” law took effect in Ohio, which removes the legal requirement that a person reasonably try to retreat from a perceived attack before responding with deadly force.

this was on WTOL channel11 website. So, can switchblades be carried in ohio now? Really?

Yes provided you are not carrying it 'as a weapon'... a knife is a tool.

great. Out of curiosity, how are brass knuckles a tool compared to a weapon?

They are a weapon. Unlike knives and other edged tools, Ohio law still considers them weapons. The new law didn't change them in any way *except* that it is now legal to manufacture and sell them. They've always been legal to possess, but could arguably be illegal to carry concealed.

Movement on what, exactly? Knife law preemption? No, I'm afraid not. It is still in the Government Oversight Committee and has not had any hearings as far as I can tell.

This was in my notifications on Oct 1 from kniferights.org..
In Ohio, proponent hearings, the second of three expected in each house of the legislature, have been held for both of Knife Rights' House and Senate Knife Law Preemption bills, HB 243 and SB 156.

Knife Rights will let you know when it is time to contact your legislators to support HB 243 and SB 156.
pretty vague as to when that happened..

Could sign up for their email list to receive updates..

I saw a message from Knife Rights today regarding SB 156
Yesterday, the Ohio Senate Veterans and Public Safety Committee passed SB 156, Knife Rights’ Ohio knife law preemption bill, out of committee with a 4-2 vote. A floor vote is scheduled for today.

Update from Knife Rights
The Ohio Senate has passed Knife Rights’ knife law preemption bill, SB 156, by a vote of 23-7. It now moves to the House where a companion bill, HB 243, is awaiting a vote by the House Government Oversight Committee, expected shortly.
