I just down loaded the new CCW book from OAG David Yost..

I have been stuck on this one thing..You can not use DF to protect another person if that person was the cause of the altercation...So your wife throws her shoe at someone that whizzed her off. That person starts to whip the crap out of your wife. WHAT DO YOU DO? I know what I would do...

A) travel alone
B) make sure everyone you are with at all times knows the consequences of starting altercations
C) use everything but deadly force
D) do what you have to and damn the consequences
E) LEFT BLANK INTENTIONALLY (I can't come up with all the good answers ;)

Good question for a lawyer to answer. I would say you could defend your wife if she was in danger even though she started it as long as she wasn't violent which I don't think throwing a shoe is too violent unless it was a 4" spiked heel!! :lol:

This is how it should be legally. But you are missing proportionally of actions. If your wife throws a shoe, and hits someone, then that person throws something back, that is proportional force. If they commence a full beat down without any other proportional force used first, they are not using proportional force and your legal loop hole has arrived. However, that is a finely-tuned argument to make, which means lengthy and takes a bunch of money.

And, if your wife escalated the incident into a beat down, then she is the aggressor and gets that treatment under the law.

I am not a lawyer, but this is how it was explained to me.

Thanks...we all get mad at drivers acting stupid..THE MISS’s seems to think sometimes she is Super Man. I tell her what are you going to do if they confront you ? Then she calms down..I love her anyway....

Naw..she hasn’t gotten to that stage...She does have her CHL though....but she does not carry....breathing a sigh of relief..
