If they are going to charge him with a Felony for taking abandoned property, they better put the hammer down on the detective that left it there. should he have taken it ? no. He should never have had the opportunity, because it shouldn't have been left there in the first place.

A homeless Florida man was charged Saturday with one count of theft of a firearm after he came across a handgun left behind by a local lawman.
The gun belonged to a PCSO detective that has not been identified. The agency has not said if he will face any disciplinary action.

Haney is charged with a felony of the third degree, which is punishable under state law by five years in prison and a fine of up to $5,000.

Ummm, I would take and remove any firearm that I found left in a public restroom.

Without trying to sound like one particular DEA guy we may have all seen... I'm likely to be the most qualified person to safely find, clear and move a left firearm than most likely anyone in the building including whatever moron left it there and any "official" who may be dispatched to eventually recover it.
I like to swap brass... and I'm looking for .32 H&R Mag, .327 Fed Mag, .380 Auto and 10mm. If you have some and would like to swap for something else, send me a note!

ST. PETERSBURG, Fla. - Law enforcement officers leaving behind their firearms inside bathrooms is not uncommon, said Russell Ricalde, a former federal agent.

“It doesn’t show that somebody is intentionally careless or has poor training," he said. "I mean it could be, it’s possible that if something happens it’s because the person was not vigilant about keeping track of their gun, but mostly it’s just circumstances."

Ricalde, who spent 28 years in law enforcement, said it has happened to most officers but there isn't exactly protocol to prevent it from happening.

“I’ve worked for five different federal agencies and with hundreds of police agencies around the country," he said. "I’m not aware of training where they tell you, ‘okay when you go in the bathroom, this is what we want you to do with your gun.’ It may exist, but I’ve never received it.”

Ricalde, who trains officers, says everyone needs a routine, which would help prevent officers from leaving their firearms in places.

“You have to do the same thing the same way every day," he said. "So, if you carry your gun on the right hip, that’s where you want to carry your gun every day. If you put your gun in a lock box when you get home because you have children, that needs to be the first thing you do when you walk in the door.”
Somebody call Ricalde when Joe Citizen leaves a gun in a stall. He'll clearly help the case.

How about a LANYARD?

Hey, why not ??? Or that little expandable bracelet that the senior citizen facilities put the residents' keys on and put it around their wrist so they can get back in their apartment after breakfast.

Well... I'm no leo, but when I do my business in a public facility it remains in the holster. If ya can't control your piece while you poop, ya shouldn't be carrying... or pooping?

Quite true, but then again I don't think anybody has alleged that. There's differing degrees of negligence. If I unintentionally cause a car accident I will likely still be cited for a traffic violation even though I didn't mean for it to happen. If I intentionally cause a car accident I may very well see upgraded charges.
