father shoots son mistaking him for car thief

Family members are mourning the death of 22-year-old Logan Trammell, who was driving away from his parent’s home in Cullman County just before midnight on Christmas Eve in one of his father’s vehicles. His father, however, happened to be sitting in his camper outside of the house and was unaware that his son was coming over to borrow his truck. He yelled and fired off a warning shot at the driver, whom he assumed was a car thief. When that was unsuccessful, he shot at the truck, which immediately stopped.

He then opened the truck door to discover he had just accidentally killed his own son.
Why would somone come over and not tell anyone that they are borrowing a vehicle?

How many ways did dad fail? I see three big ways right off the bat:

- Using deadly force in defense of property without any reasonable fear for his life
- Warning shot <sigh>
- Lack of positive target identification

I have a feeling dad is going to get to regret his decisions beyond the mourning of his son - quite possibly behind bars.

The son might not have been too bright either, going to his fathers at midnight to borrow a vehicle without trying to inform someone there what he was doing. Not defending the fathers actions, he did everything that JustaShooter said.

There's a neighbor of mine who said if I needed to borrow one of his space heaters to work on the car in the garage I could borrow it. I think I'll go over there tonight at midnight unannounced and see what happens

Dad made a couple really bad mistakes and probably will go to prison for while..
I cannot imagine how I would feel if I had killed my son...........

I don't know about whether he will go to prison or not in that jurisdiction, but in general I agree with you.
