Re: List your notification horror stories here
Not me but my wife:
We used to live in an apartment complex in Berea. She has had her CCW for several years. She worked second shift plus OT which meant she would get home around 1:30 AM most nights. Officers routinely cruised the complex parking lot at night, which wasn't a problem. One night an officer follows her into the parking lot and decides that he's gonna check her plate. She parks and heads in, after probably a minute the officer pulls up behind her, lights going, and stops her.
Why did he stop her? Because in the computer system - at least in Berea, your name comes up in red if you have a CCW. It also comes up in red if there's a warrant out for your arrest. He saw the Red when he ran her plate and didn't bother to check to see what the notification was for, and assumed she had a warrant.
When she informed him that she shouldn't have a warrant but she does have her CCW, he checked and saw that there was no warrant out for her arrest and that indeed the notification color on her name was to alert her that she may be armed. He then berated her for not notifying (even though she wasn't armed) and threatened to arrest her for not notifying. He didn't like her response - that if she's unarmed she doesn't have to notify - and had her wait in the back off the cruiser until he could verify that. When it was verified that she was indeed correct, he was angry that he had to let her go.

Really appreciate you passing that along, Thanlon. However, the impetus for this thread was to gather these stories to present to the Ohio General Assembly last year, as they were (supposedly) working on a bill that would have eliminated the notification requirement. That ship has sailed, we lost like OSU vs. Clemson.
Quit worrying, hide your gun well, shut up, and CARRY that handgun!

Well, if there's another run in the future at eliminating the notification requirement, feel free to use it.Brian D. wrote:Really appreciate you passing that along, Thanlon. How long ago did that happen to your wife? Just curious as to how far behind the curve that cop is.

I am hopeful that there will be another run this. Notification is one of the things that I really want to change.Thanlon23 wrote:Well, if there's another run in the future at eliminating the notification requirement, feel free to use it.Brian D. wrote:Really appreciate you passing that along, Thanlon. Their is no excuse not to under stand the law. We CHL holders are required to know the laws, police not so much. Imo she was falsely detailed,... that violated her civil rights under the color of law.Brian D. wrote:Really appreciate you passing that along, Thanlon. Re: List your notification horror stories here
True as that may be, read up and see if you can find anybody who got an outright win or even a decent financial judgment when they were detained like that. I'm not saying you can't prevail if blatantly wronged, but the law enforcers and courts protect their own. The legal system acts like your time wasted in such a detention is worth about a nickel a minute. And your lawyer would get a third of it for making the case on your behalf!steves 50de wrote:Their is no excuse not to under stand the law. What do we do Brian lay down and let this continue, or try and come up with a plan to change the behavior.
I will bet the one's that do this know exactly what they are doing. Any action has to be on civil rights violation not on someones time being detained.

Hope you have big bucks to hire the attorney on that fact pattern because he won't take it on a contingency if he is any good at all and understands the law and how the courts work.steves 50de wrote:What do we do Brian lay down and let this continue, or try and come up with a plan to change the behavior.

Yes, I forgot that attorney don't want to do anything unless it's a slam dunk.schmieg wrote:Hope you have big bucks to hire the attorney on that fact pattern because he won't take it on a contingency if he is any good at all and understands the law and how the courts work.steves 50de wrote:What do we do Brian lay down and let this continue, or try and come up with a plan to change the behavior.

It's a slam dunk that there won't be any big damages.steves 50de wrote:Yes, I forgot that attorney don't want to do anything unless it's a slam dunk.schmieg wrote:Hope you have big bucks to hire the attorney on that fact pattern because he won't take it on a contingency if he is any good at all and understands the law and how the courts work.steves 50de wrote:What do we do Brian lay down and let this continue, or try and come up with a plan to change the behavior.

No, but you can make as big a fuss as possible to EVERYONE in his chain of command. Publish the LEO's name and info far and wide. Do everything legally possible to make his life miserable.
