This sub-forum is strictly for the purpose of submitting of, and status updates related to, ORC 9.68 compliance. This could mean park bans, open carry bans, or anything that is a compliance issue. Note the format in which original threads were created. Please try to research contact information for each city, village, etc, Email, fax, and postal addresses are great. Digital photos of infractions (Signs) are ideal. anyone have a list of the fairgrounds where you are allowed to carry??

I'm pretty new and in the process of getting my license

Find a list of Ohio Fairgrounds and you've found the list of ones you're allowed to carry in.

We can carry on all the grounds regardless (irregardless :P ) of what signs at the front gate say however you're not allowed to carry INTO buildings. That makes it kinda tough to see all the exhibits.

Some boards say they are not a government entity, but time after time, we've proven them wrong.

Yes, what they said. (carrying on the fairgrounds) The problem was the last time I went to the fair, every building was posted, including a buildings that were nothing but restrooms.

Fairgrounds are a real quagmire. The grounds cannot be posted (legitimately) but the buildings can unless they are a restroom or a shelter. What is a shelter? Is a barn a shelter? All it does is provide temporary shelter for livestock. Is an exhibit building with a big "TORNADO SHELTER" sign by the door a shelter? All the time or only when a tornado is present? Then if a private entity rents the grounds they can make up their own rules.

We really need to work on carry in all gov't buildings and stop all this foolishness.

Better slow down, lads. There are fairgrounds that are owned by private agricultural societies which are treated just like any other premises owned by a private entity. They can post the premises, and you had better comply.

The buildings are another issue. Most buildings lie vacant year-round, and they don't qualify as government facilities. But some - maybe the one that houses the fair board office - may be legitimately posted as a government facility.

And then there's the issue of the premises being leased to a private entity. Try carrying a loaded gun into one of the several gun shows held on fairgrounds in this state. Let us know how that works out for you.

Which ones are 'private'?

County Ag Societies are political subdivisions of the state. [Greene Cty. Agricultural Soc. v. Liming, 89 Ohio St.3d 551, 2000-Ohio-486]

They accept money from the state for 4-H or harness horse racing, they should lose the ability to claim private entities.

So the reason a fair gets away with posting a building that has nothing but toilets and sinks inside is that it's a government facility or shelter? They were concrete block buildings so I guess they could serve as an emergency shelter.

The definition of government facility is a little more complex than anything other than a restroom or shelter. The facility must also be regularly occupied by government employees carrying out their duties. Problem is I'm not aware of any case law on what does and what does not qualify as regularly being present in this context and it's only a felony to guess wrong.

Personally I believe the correct definition to be the more common one, which is what one would consider to be a traditional government facility: Government workers are present according to some set schedule some number of days a week. It doesn't have to be five days a week, 9-5 but there has to be some regularity. That is, someone is scheduled to work there on a regular basis.

But what do you do about the building that sits empty most of the time but every two weeks or so Earl sticks his head in to make sure the pipes haven't burst? Someone could make an argument that he is regularly in the facility by virtue of it being on his regular inspection rounds and he is unquestionably carrying out his duties by making sure the pipes are intact. Or what about the fair board employee who does a walk through of the building before and after it is rented to a private entity? That occurs regularly (before and after every rental) although not on a fixed timetable.

It's arrogance based. Before we got "rest area carry" approved, ODOT apparently even considered the small outhouses and port-o-lets at the oldest state roadside rests to be "buildings". Yeah, they SMELLED like government was working inside them, but... :lol:

I see these fairground boards as having about as pompous a mindset.

Yep. Went to a gun bash at Hartford Fairgrounds not long ago. The fairgrounds weren't posted, but they could have been. And the building where it was held was clearly posted because a private entity had leased it: no concealed weapons and no loaded weapons.

Maybe now is the time for the members in these Counties to work on educating the Fair Boards? Instead of waiting till a week before the Fair!
