The Firearms Policy Coalition on Wednesday sent a letter to Senate Majority Leader Mitch McConnell (R-KY) stating their opposition to William Barr being confirmed as Attorney General. Their biggest objection to Barr is over his previously stated support for Extreme Risk Protection Orders (ERPO), commonly referred to as "red flag laws," and his belief that "there is room for reasonable regulation" of the Second Amendment.

“This is a strong indicator that Mr. Barr, if confirmed, would not only maintain the DOJ’s troubling current litigation positions, but potentially even direct United States Attorneys and DOJ civil litigation counsel across the nation to take even more aggressively anti-rights, authoritarian positions in a wide variety of prosecutions and constitutional challenges. That is not the proper remedy for centuries of constitutional resistance and atrophy,” the group said in the letter. “We believe that the views expressed by Mr. Barr disqualify him from serving as the Nation’s highest law enforcement officer. The Constitution, the People of the United States, and law-abiding gun owners do not need another enemy.”

Gun Owners of America expressed similar concern with Barr's nomination and sent out an action alert to gun owners across the nation. The group encouraged their members to call their Senators and let them know they oppose Barr because of his alleged anti-gun position.

"...when Barr openly spat on the right to keep and bear arms on Tuesday -- and threatened to break down our doors in the middle of the night in order to confiscate our guns -- well, that’s a problem for us," GOA's Executive Director, Erich Pratt, said in the alert. "Listening to William Barr, there is no doubt that he will be an enemy of the Second Amendment. He even talks like an anti-gunner."

Barr received a routine questionnaire from the Judiciary Committee asking him to disclose his past work including pro bono activities “serving the disadvantaged.” The “disadvantaged” that Barr spent the most time helping was an FBI agent who slayed an Idaho mother holding her baby in 1992. Barr spent two weeks organizing former Attorneys General and others to support “an FBI sniper in defending against criminal charges in connection with the Ruby Ridge incident.” Barr also “assisted in framing legal arguments advanced… in the district court and the subsequent appeal to the Ninth Circuit,” he told the committee.

That charitable work (for an FBI agent who already had a federally-paid law firm defending him) helped tamp down one of the biggest scandals during Barr’s time as Attorney General from 1991 to early 1993. Barr was responsible for both the U.S. Marshals Service and the Federal Bureau of Investigation, two federal agencies whose misconduct at Ruby Ridge “helped to weaken the bond of trust that must exist between ordinary Americans and our law enforcement agencies,” according to a 1995 Senate Judiciary Committee report.

Barr recently testified on RKBA...
And so there is no question under Heller that the right to have weapons, firearms, is protected under the Second Amendment and is a personal right. At the same time there is room for reasonable regulation.

From my standpoint, what I would look for, in assessing a regulation, is what is the burden on law-abiding people and is it proportionate to whatever benefit, in terms of safety and effectiveness, will be conferred.

As I said, just a moment ago, lets get down to the real problem we are confronting, which is keeping these weapons out of the hands of people who are mentally ill. I think all the rest of this stuff is really, essentially rhetoric, until we get that problem dealt with; in terms of regulatory approaches.”

During his confirmation hearings, Barr was asked about guns and his answers are encouraging and seem to say that he is very pro-Second Amendment.

With his answer on guns to a question by Senator John Cornyn, it appears that Barr thinks that the Second Amendment is an individual right (not a “collective” right open to vast regulation like leftists think). His answer also showed that he thinks new regulations need to be tested against how it will affect law-abiding gun owners first (not crime, or criminals first), and that he feels the amendment is an extension of our god-given rights under “natural law” concepts. He also opposes an “assault weapons” ban, which is also a good thing.
