Donald Trump is set to inherit an uncommon number of vacancies in the federal courts in addition to the open Supreme Court seat, giving the president-elect a monumental opportunity to reshape the judiciary after taking office.

The estimated 103 judicial vacancies that President Obama is expected to hand over to Trump in the Jan. 20 transition of power is nearly double the 54 openings Obama found eight years ago following George W. Bush’s presidency.

Confirmation of Obama’s judicial nominees slowed to a crawl after Republicans took control of the Senate in 2015. Obama White House officials blame Senate Republicans for what they characterize as an unprecedented level of obstruction in blocking the Democratic president’s court picks.

The result is a multitude of openings throughout the federal circuit and district courts that will allow the new Republican president to quickly make a wide array of lifetime appointments.

Regarding the 9th Circus
Often cast as liberal-leaning, the 9th Circuit spans nine Western states of amazing diversity from conservative Arizona, Idaho and Alaska to liberal California, Washington and Hawaii. The 29-judge court is numerically dominated by Democratic appointees, 16 of whom were named by presidents Barack Obama or Bill Clinton. There are currently two appellate-level vacancies, and two additional seats will become vacant when other judges assume senior status at the end of the year.

Hinting at the potential for change, more than a dozen of the 9th Circuit’s current active judges will be 65 or older next year.

Still, a makeover will take time. Two of the four immediate 9th Circuit vacancies that Trump could face when he takes office have already been held by Republican appointees, so filling these seats could simply amount to a GOP-to-GOP lateral pass.

“On the one hand, he may not be able to reshape the court very much,” Carl Tobias, a University of Richmond School of Law professor who studies the circuit, said Wednesday. “On the other, he may not need or want to reshape the court much, as some observers suggest that the court is more moderate today than when Obama assumed office.”

There are 81 vacancies nationwide on the trial-level federal district courts, including five in California, three in Washington, and one in Idaho.
Liberals are panicking about the fact that President-elect Donald Trump will be able to fill four vacancies on the historically left-leaning Ninth Circuit Court of Appeals when he takes office later this month.

Outgoing Sen. Barbara Boxer (D-CA) called the vacancies a “judicial emergency,” according to Bay Area public radio station KQED, even though there are 29 judges on the court. The “emergency” is that Trump’s nominees might be able to make the court more conservative.
