Nearing retirement guy was apprehending a burglar less than half his age. What moron would even entertain the idea of arresting him.

A New Hampshire man who fired his handgun into the ground to scare an alleged burglar he caught crawling out of a neighbor's window is now facing a felony charge -- and the same potential prison sentence as the man he stopped.

Dennis Fleming, 61, of Farmington, was arrested for reckless conduct after the Saturday incident at his 19th century farmhouse. The single grandfather had returned home to find that his home had been burglarized and spotted Joseph Hebert, 27, climbing out of a window at a neighbor's home. Fleming said he yelled "Freeze!" before firing his gun into the ground, then held Hebert at gunpoint until police arrived.

"I didn't think I could handle this guy physically, so I fired into the ground," Fleming told FoxNews.com. "He stopped. He knew I was serious. I was angry … and I was worried that this guy was going to come after me."

No one was injured in the incident, but when the police arrived, they made two arrests. Hebert was charged with two counts of burglary and drug possession. He faces up to seven years in prison if convicted. Fleming, meanwhile, is scheduled to be arraigned March 20 on a charge of reckless conduct, which could potentially land him a sentence similar to the one Hebert faces.

If Mr. Fleming was quoted accurately in this article then this is a good example of saying nothing until your lawyer is present. He admitted to firing the shot then said that he thought the burglar would come after him.

Hope if this goes to trial the jury will exercise good judgment.

I'd love to be on that jury. This falls into my "you've got to be kidding" category. The prosecutor will probably offer him a lesser charge if he pleads guilty. He'll take the deal to avoid a trial.

There's not enough police to prevent crimes and the legislature writes laws that prevent honest citizens from doing anything.

If our lawmakers really wanted to reduce crime, quit rewarding the criminal and punishing the innocent. It's not that hard.

There's no such thing as "enough police to prevent crimes"
Police only react after a crime has been committed, as they should.

BTW, update on this topic. Justice prevailed and charges were dropped.

Has any one looked at the scenerio as, the perp knows you've seen him and can ID. Maybe he is a two time loser and will come back to eliminate you as a witness? He's already been in your house. Knows his way about the residents, not a good situation. hey?

I have no need for warning shots. See the gun your getting shot with the gun. If I didn't need to shoot you with the gun you're never going to see the gun.

good they let him go. he did the right thing i guess. it's hard to detain a guy who's much bigger & stronger than you. big reason why the cops use taser guns. me, personally, when it comes to non lethal defense, i probably wouldve pepper sprayed that thief in his eyes and punt kicked him as hard as i could right in his family jewels :lol: then call 911 and wait for the cops to come. mace starts wearing off, mace him again and kick his jewels again, and again, till the cops come :lol:

...Even stayed my fingers from correcting the spelling/grammar errors. I may even steal it (a more English-friendly version rather) for a sig.
