POTUS continues to reject Due Process

Post by bignflnut »

Remember when POTUS said "take the firearms first and then go to court"?

That didn't seem to rile many in the proRKBA community, for whatever reason.

Due process is referenced in the 5th Amendment: "No person shall ... be deprived of life, liberty, or property, without due process of law ..."

What is due process?
"Due process deals with the administration of justice and thus the due process clause acts as a safeguard from arbitrary denial of life, liberty, or property by the government outside the sanction of law."
Rejections of due process are exceedingly applicable to any Right, be it speech, arms, or any of the other Negative Natural Rights recognized by the American Philosophy of governance. Whomever the POTUS, in any era, reductions of due process should be considered the most offensive of tyrannical proclamations.

Proving that the previous declaration was not an exception, but the baseline...
President Donald Trump escalated the debate over immigration this weekend in calling for the deportation of people who “invade our Country”, without hearings or judges. The call would raise serious questions under both U.S. and international law. It would be a denial of the most basic protections of due process for those with credible claims for asylum. The position is both extreme and untenable if he is referring to any and all cases. It also undermines otherwise strong arguments being asserted for expedited procedures for dealing with the influx of undocumented persons.

This weekend, Trump tweeted “We cannot allow all of these people to invade our Country. When somebody comes in, we must immediately, with no Judges or Court Cases, bring them back from where they came.”
I'm all for upholding and enforcing national borders.

That said, the governing bodies of the USA should be committed to justice and truth, prescribed by our various Constitutions via due process. Yes, even non-citizens should be given fair and speedy trials, because we desire our own freedoms to be unrestrained by governments with limited powers. As standards of justice and truth seem to be turning away from the principles that gave birth to the States and our nation, it should not be surprising that our Rights are being diminished by the people who reject eternal standards, in the name of expediency and political gain.

The US Constitution and the Bill of Rights establish the legitimate powers and form of federal government. It speaks of the people, as in all of humanity, not the citizens alone. We would do well to recognize threats, particularly from those dressed in sheep's clothing.

"Avarice, ambition, revenge and licentiousness would break the strongest cords of our Constitution, as a whale goes through a net. Our Constitution was made only for a moral and religious people. It is wholly inadequate to the government of any other." John Adams to Mass Militia 10-11-1798
