Post by Bruenor »

AFAIK ERPO legislation hasn't yet passed in PA.

A man who caused alarm while walking around several suburban Philadelphia neighborhoods with an AR-15 rifle slung behind his back has been taken into custody and is undergoing a mental health evaluation.
On Friday, Molloy said, friends of the man reached out to police with concerns that he could pose a threat to himself or others. That new information led police to take him into custody on Thursday.

The man, who police did not identify, is undergoing an involuntary mental health exam.

2. Believes in the 2nd Amendment - Check
3. Since 1 and 2 are true, then subject must be mentally ill - Check

Chief Patrick Molloy told residents in a letter that while the man’s intentions were unknown, they believed he was trying to draw officers into a debate over his Second Amendment right to carry the weapon in public.
(grasps pearls)

Here's hoping he has an advocate who will make his case with vigor.

On May 3, 2018, as a result of an investigation, officers of the Abington Police Department assisted Montgomery County Emergency Services in taking a Township resident into custody for an involuntary mental health evaluation warrant. This is the same individual recently observed walking through the Township with an AR-15 rifle. This case illustrates the very complex nature of balancing an individual’s 2nd Amendment rights with our primary mission to protect and serve all of our citizens. This individual’s decision to exercise his rights does not, by itself, warrant an involuntary mental health evaluation. However, additional information was received which warranted steps to be taken for his safety and the safety of our citizens.

While conducting the search warrant and talking with friends of the unknown man who has not been charged, police discovered that he spoke about shooting up the Abington High School in June 2017 and Penn State Abington in January.

Friends of the man also shared that they received suicidal messages from the individual. Searches on his cell phone confirmed that he could have potentially been plotting a shooting as he was looking for “what guns were used in mass shootings,” “sandyhook,” and “how many mass shooters have fatherless homes."

Actually the friends never did report it. It wasn't until a police officer was at their door asking specific questions about the man that they spoke up.

And herein lies the rub with so many mental health and domestic violence cases. With a few exceptions nobody wants to fink on a friend or relative. They hope that if they close their eyes the person's behavior will return to normal and they can all act like it never happened. Then there's a triggering event like an overt act of violence, or a police investigation and people start to open up with "oh yeah, there was this one time..." My personal opinion is that they're somewhat relieved when the police show up because then they can tell what they've wanted to tell for some time. You just hope that by then it's not too late.
