His attorneys are claiming the ex cop allegedly identified himself as a cop, but the prosecution allegedly has a tape of some kind involving a tow truck driver allegedly proving that wasn't the case. The victim had a concealed carry permit and allegedly pointed his gun at the defendant, but didn't shoot, and that's when the cop fired. He allegedly also fired even after the gun was on the ground. His attorneys are also using the stand your ground defense, although the stand your ground defense in Florida allegedly doesn't allow for the defendant to claim it if you are the aggressor. His trial was supposed to start in May, not sure if that will change or not.
