Clayton Jerrell Morgan, 36, was shot and killed during the attempted robbery, during which a toy gun was brandished, according to the Amarillo Police Department. Police also arrested his alleged accomplice, 29-year-old Ruben Ryel Rios, on a murder charge because Morgan died during the commission of a felony.

A police spokesman said last week that the employee, who is licensed to carry a firearm, has not been charged with a crime because the shooting was considered justified.

“Our policy always has and always will be that our employees are welcome to legally and responsibly possess the means to defend themselves and others around them,” the statement reads.
