Since they specify that she failed to inform I'm guessing she has a CHL. How do people who are licensed still not know they need to notify in Ohio ?

Carrying a concealed weapon, Shaker Boulevard: At 8:30 a.m. Nov. 15, police stopped a car driven by a Cleveland woman, 25, as it was being driven at a high rate of speed. During the traffic stop, the woman failed to inform officers that a gun was in her car.

She was charged with carrying a concealed weapon.
Would this be the appropriate charge? Shouldn't it be failure to notify?

Good point, so no CHL then, so she has no requirement to notify and shouldn't.

And that's the insidious thing. Failure to notify is not a different section of the revised code; it's contained within carrying concealed weapons and improper handling firearms in a motor vehicle.

Failing to notify means you get charged with CCW or improper handling. Looks great to prospective employers, 'eh?

How was she treated? Cuffed and stuffed or just issued a citation? A full arrest or just a ticket on the side of the road, disregarding the high rate of speed and possible reckless operation.

There is no charged titled "failure to notify." That's one of the reasons behind OFCC being against HB 142 in it's current amended form. You forget to notify and you now have "Carrying concealed weapons" showing on your arrest record for the rest of your life unless you get it sealed.

There are so many twists to it. I went in the ditch once, had gun in glove box, tow truck shows up.

Then later OSHP trooper shows up, I am OUT of the truck and truck is locked. I did not notify, IMHO I was not required to. Trooper does basic report, property owner was there, no damage. Tow truck driver asks me to get into truck and steer while he pulled it out of ditch. Notified THEN.....trooper had a fit because I had not already notified. No ticket or anything but still.

Might not look so good to current employers, either. As a hospital employee, I would have to disclose that I was arrested and be suspended until HR is satisfied. If I get charged for not notifying, I expect to kiss my job goodbye. HB sub 142 will not help either.
