CPD rehires 5 of 6 officers involved in 2012 chase/shooting

Post by Bruenor »

Brelo is the only officer from this incident not to be rehired.

The officers will not be paid from the time they were fired to the time the arbitrator decided they would be reinstated as part of the arbitration ruling. However, they will receive back pay from June 13, 2017 when the decision was made.

“We are not surprised by the arbitrator’s decision,” Moriarty said. “We had hoped all six officers would be restored to their duties.”

Mayor Frank Jackson, on the other hand, is not happy with the decision.
I'm usually very supportive of our police, but this seems a bit of a surprise. The whole chase and shooting was over the top, something that should have been from the Hollywood screen rather than a real life incident.

That's how things tend to go when management fails to consistently issue discipline in the years and decades leading up to an incident where they actually want to impose it.

We actually got hit with it many years ago...

In short, my department learned to not hold on to discipline and wait 2+ years to enforce it with a 62 page internal. Sure, you don't want to come down on everything, but violations MUST be documented if the person is working with a union contract. The biggest failure in union organizations is progressive discipline. They want to jump to the top and lump a bunch together when progressive discipline fails to allow that. Then they act surprised when an arbitrator rules against them.

I am not a lawyer. My answers are based on research, knowledge, and are generally backed up with facts, the Ohio Revised Code, or the United States Code.
