Quigley,

I suppose what you referenced, but may have been missed is the fact that the person who was the subject of the desired blood sample, being treated, was a Police Officer. Funny twist in the incident.

No, I didn't miss it at all. I read the other news story, I know it said the unconscious person was also a LEO. That's why I said "one of the potential victims". In most situations where a LEO is accused of some wrongdoing, the FOP takes the side of the LEO, and sometimes against whoever was the alleged recipient of the wrongdoing. (which is usually not an LEO)
In this case though there was a situation where one LEO was allegedly trying to violate the rights of another LEO. Granted, the accident victim wasn't a full timer, but he was still an LEO. Some of the people off the net that I've heard talking about this nationwide news story have missed that detail however. That shouldn't however make a difference, whether the victim is an LEO or not, about the victims rights. I don't however work for the FOP.

This is body cam footage of the watch commander on duty at the time, James Tracy, who apparently ordered the arrest talking with the arresting officer. Jump to 0:29 where he says "I don't think this arrest is gonna stick."

They need to put the boot in and make all of their interactions with the local PD VERY uncomfortable. And they need to make it very clear whose fault that is.

This situation is going down a slipper sloop. What happens if hospital security can't handle an unruly patient and have to call police? How soon will police respond? All because of one officer that abused his authority.

Not one, at least two. And that doesn't count the hospital cops who stood around and watched it happen.

And does this only go one way? Should the nurses be able to slow walk treatment for a cop who comes in with a gunshot wound?

Actions have consequences... apparently unless you're a cop.

On Tuesday, Payne was fired from his part-time paramedic job at Gold Cross Ambulance, according to a statement from the company, which cited the detective’s remarks about transporting patients as the reason. In the video, Payne could be heard telling another officer that as a first responder he could “bring them all the transients and take good patients elsewhere” if Wubbels refused to let him draw blood.

After the footage was released, Gold Cross Ambulance President Mike Moffitt said, “That’s not the way we conduct our business, that’s not the way we treat people in our city,” according to the Associated Press. Gold Cross said Payne’s firing was effective immediately and stressed that he wasn’t working on behalf of the company during his dispute with Wubbels.

Instead of interacting with nurses as a first point of contact, police will now make requests to “house supervisors,” who are highly trained in medical laws and hospital rules, medical officials said Monday. Additionally, police will no longer have access to patient-care areas.
What difference is that going to make? She checked with her supervisor about this at the time, and he knew it. Is a cop going to give a supervisor more consideration than a staff nurse? If a cop decides he doesn't care about the new hospital policy, who is going to enforce it, possibly against the cop? Hospital or campus security? Do they even have the legal authority, or do they risk getting arrested like a nurse?

Any bets on whether the cop involved will claim PTSD?

Oh it stuck alright. Just not in ways they anticipated.

That's kind of ironic, the watch commander ordering the arrest, then telling the arresting officer a half minute after the arrest "I don't think this arrest is gonna stick." Perhaps both of them should've taken the extra half minute to actually think about what they were doing, and the possible downside of it. It wasn't like the victim was going to wake up in the next 30 seconds and run out.

Ironic to have a nurse uphold a patient's 4th Amendment Rights against someone who is actually duty bound to uphold those Rights.

Recognizing that we're not to care about ol' number 4...
Our freedoms - especially the Fourth Amendment - are being choked out by a prevailing view among government bureaucrats that they have the right to search, seize, strip, scan, shoot, spy on, probe, pat down, taser, and arrest any individual at any time and for the slightest provocation.

Such is life in America today that Americans are being made to relinquish the most intimate details of who we are - our biological makeup, our genetic blueprints, and our biometrics (facial characteristics and structure, fingerprints, iris scans, etc.) - in order to clear the nearly insurmountable hurdle that increasingly defines life in the United States: we are now guilty until proven innocent.

Forced cavity searches, forced colonoscopies, forced blood draws, forced breath-alcohol tests, forced DNA extractions, forced eye scans, forced inclusion in biometric databases: these are just a few ways in which Americans are being forced to accept that we have no control over our bodies, our lives and our property, especially when it comes to interactions with the government.

Consider, for example, what happened to Utah nurse Alex Wubbels after a police detective demanded to take blood from a badly injured, unconscious patient without a warrant.
Cop on cop crime with a patriotic/heroic nurse standing in the gap.

BTW, can anyone define sobriety for me? 70% of Mericans are on a prescription drug, drivers vary from young to old, well rested to sleep deprived to mentally distracted. We've got 4 different shades of OVI, DWI, DUI, OMVI and all sorts of impairments being cited vs sobriety...how can we not be forced to give blood at each interaction? Bah...forget that 4th Amendment stuff.
