SC Officer Charged with Murder
A grand jury on Monday indicted a white former police officer on a murder charge for the shooting death of a black man in North Charleston, South Carolina, according to the prosecutor overseeing the case. Michael Slager, 33, was fired from his patrolman job after being charged with murder in the April 4 death of Walter Scott, 50, who was fatally shot in the back as he was running from the officer following a traffic stop.

I don't know how he could ever get out of his situation. He shot the guy in the back and then threw his tazer on the ground next to the guy.

Watching this video is like watching the surveillance of the OK pharmacist who was fine shooting the robber up until the point that he got another gun, loaded it and administered a head shot on the now unconscious robber.
Everything was fine as to use of force until he shot a fleeing unarmed man who other than resisting arrest posed no credible danger to anyone. The guy knew he did wrong because he moved the tazer next to the dying man rather then render medical aid.

Uh-huh. Right. I'm sure this is shocking to many in these forums who live in a black-and-white reality. The truth is that juries exist in a very gray reality, and not everyone thinks like you do. Or did everyone forget what happened three weeks ago in Cincinnati?bignflnut wrote:

When I got the questionnaire, I had to use a separate sheet of paper to list all the lawsuits and trials that I was personally involved in. (Too many ex-wives)
During the selection process, I made it to the semi-finals and 24 of us were being questioned during the voir dire phase.
Most of the questions had to do with whether we were ever a victim of a violent attack or had to use force to protect ourselves. My hand was up quite a bit. Like I said, I had too many ex-wives and a mother-in-law that tried to have me murdered once. The attorneys probably thought I was making it a hobby of going to court all the time.
Toward the end of the voir dire phase; one of the attorneys asked, “Is there any reason that myself or the other side should have some concerns about anyone of you serving on the jury?”
I raised my hand and the attorney remarked, “Why am I not surprised?”
I said that even though I was not an attorney I had been in and out of court so much that I was familiar with tricks that attorneys will pull in court. I was pretty good at seeing when some gamesmanship was being played so that justice & truth were not being pursued just to win the case.
He then asked me if that would affect my objectivity. I said that it would not. I looked at the defendant and said that all I know was that he was accused of a crime and that I have no opinion about him. In my regular job, I have to do some investigatory work. So when I start my investigation I do not have any presuppositions. I just gather the information and ask questions. My goal in my investigations is to determine the root cause of the problem. My attitude was the same for that trial.
Nevertheless, I was excused. I had an opportunity, later, to speak with the defense attorney and he told me that both he and the prosecutor didn’t want me on the jury.
They probably didn’t like the fact that I could tell if they were playing games.

In this case, it may have been the judge who was playing interesting games.
According to The Conservative Treehouse, which may be a bit inconsistent in its quality, there was a hold-out juror for murder. The judge released that the count was 11-1. The judge told them to go back to the jury room for a third try. At the end of closing arguments, in the jury instructions, the judge instructed the jury that they could consider manslaughter as well as murder. That was the first they heard about manslaughter. Later on, something was said about several jurors not being able to decide if it was manslaughter, and that is why a mistrial was called.
The guys at CTH make this sound unusual, and grounds for appeal, should he have been convicted.
Officer Slager testified that Scott ran 200 yards, then there was a fight in which the taser came out. Slager said that he himself was tased, and thought Scott still had the taser. That was why he fired. Fight to shot was about 6 seconds. Scott's fingerprints and DNA were found on the taser.
I am not sure how loopy one gets after being tased, but if he was, that would certainly lend weight to his claim of self-defense.

TBH I was shocked. They once again showed the video of the incident. Sorry folks...IMO that was execution style...you could even see the casual, relaxed attitude of the officer during the shooting. The way he raised his gun and fired was not out of panic...more like frustration..."how dare you ignore my commands and run away from me....I am da law!" There is more evidence than a video, and videos don't always tell the whole story.
Obviously, the jury thought so, too. Malice aforethought was supposed to be a defining factor to murder. They could not find that. There evidently were 5 who could not decide on manslaughter, either. Looks like they did not see a relaxed, casual attitude in the officer.

I did..unless the officer new this guy was committing a felony he should of chased him down..Not shoot him 8 times..the jurors that didn't see it this way are idiots...if you have to draw your gun and shoot in this situation, you are in need of a new occupation.....
