NJ: Partial Victory for Gun Owner
More details at the link but here’s a brief wrap leading to yesterday’s court ruling: Brian Aitken was in the process of moving from Colorado to New Jersey. He owned several guns and ammunition legally — at least in Colorado. But, not in New Jersey. He goes for a drive, his Mom calls cops, they search his car when he returns. Arrests him on various charges. Judge rejects claim that federal law allows for transportation of firearms in a case like this. Sentenced to seven years in prison, Gov. Christie commutes his sentence.

Now, Aitken has been partially vindicated.
From the Courier Post Online:
In Friday’s ruling, a two-judge panel said Morley was wrong, and that jurors should have been allowed to consider the exemption argument. The panel also overturned Aitken’s conviction for possession of a large-capacity ammunition magazine, saying the prosecution had failed to show the magazines were operable. However, the appeals court upheld Aitken’s conviction for possessing hollow-point bullets, rejecting his argument that ammunition should also fall under the exemption for weapons being moved.
Aitken’s lawyer is considering an appeal of the conviction for possessing ammunition that is illegal in N.J. If that conviction is not overturned, it will mean, sadly, that Aitken will not be able to own firearms in the future.

Please tell me, dear Tither, you're not advocating support for an unworthy candidate based on the judges that he/she might, theoretically, maybe, if the mood strikes, appoint a judge or two that we agree with.
