Not required to point it to be charged with aggravated menacing.

Yup

It's a big ugly Hi-Point. Great job, slack-jawed idiot. Thanks so much for that.
I like to swap brass... and I'm looking for .32 H&R Mag, .327 Fed Mag, .380 Auto and 10mm. If you have some and would like to swap for something else, send me a note!

He was aggravated and he sure looked menacing. :shock:

He is lucky the vics did not try to stop the threat.

Capt Larry Robinson, of the Mississippi County, AR, Sherriff's Dept called it 'Aggravated assault'.

He was aggravated, but do they consider touching the camera the 'assault'?
They make it sound like handling the gun was the chargeable offense.

I love how the reports voice goes up about 2 octaves as she is by her news truck...

When out in public you have no expectation of privacy and therefore can't touch the camera to stop the recording of you. So I guess perhaps the Ag assault charge might stick. I feel the Ag menacing would be an easy burden to prove. I personally wouldn't vote to convict for assault on the camera touching.

The guy is a certified dumb *** and should be convicted for menacing.

Like Ohio, Arkansas Code does not require an actual touching or harm for the charge to apply:

A.C.A. § 5-13-204 - Aggravated Assault
(a) A person commits aggravated assault if, under circumstances manifesting extreme indifference to the value of human life, he or she purposely:
(1) Engages in conduct that creates a substantial danger of death or serious physical injury to another person;
(2) Displays a firearm in such a manner that creates a substantial danger of death or serious physical injury to another person; or
(3) Impedes or prevents the respiration of another person or the circulation of another person's blood by applying pressure on the throat or neck or by blocking the nose or mouth of the other person.
By comparison, here's Ohio's statute - 2903.12 Aggravated assault.
(A) No person, while under the influence of sudden passion or in a sudden fit of rage, either of which is brought on by serious provocation occasioned by the victim that is reasonably sufficient to incite the person into using deadly force, shall knowingly:
(1) Cause serious physical harm to another or to another’s unborn;
(2) Cause or attempt to cause physical harm to another or to another’s unborn by means of a deadly weapon or dangerous ordnance, as defined in section 2923.11 of the Revised Code.
