They know it's futile. It's nothing but posturing for the next election.

Yup, it shows they are trying to do something. Also, they get to play with pretty much an unlimited budget. Whereas OFCC relies on donations and attorneys willing to work spending their money to get reimbursed by either us or the entity they are suing. Which show far in the Oberlin and Cleveland cases we haven't been awarded anything.

I think almost all of these ordinances will stick.
  • The bump stock ban violates preemption, though Trump is trying to give Columbus a nationwide ban.
  • Imitation firearms are not firearms, so preemption does not apply.
  • Preemption does allow zoning ordinances to ban gun sales in certain zones just as they can ban every other business activity. So banning sales in residential zones is legal.
  • Several ordinances increase punishment for existing crimes if committed with a firearm or enhance enforcement of existing crimes. For example, it's already illegal for minors to have a firearm, so making it easier to turn in an armed minor and seize his gun is not preempted.
  • The rest mirror state or federal law, which even if they get preempted is moot since it doesn't make anything newly illegal.

From today's Columbus Dispatch:
The public will have its say on gun-regulation proposals that Columbus city officials rolled out in late March.

The Columbus City Council will have a public hearing at 5 p.m. Thursday in City Hall to discuss the proposals. The hearing will include presentations on the proposals and a public comment period.
The city is pushing its proposals as a national debate about gun control is intensifying amid mass shootings across the country and as Gov. John Kasich tries to get his own gun policy recommendations through the state legislature.

Ginther joined Kasich at a news conference Monday in which the governor signed an executive order to improve background checks and prevent the sale of guns to criminals and the mentally unstable.
First I've heard about Kasich doing something gun related yesterday.

If they want to do something useful, why don't they put some teeth into the current reporting laws ?

(OH) State law requires courts to update the list of individuals barred from buying firearms at least once a week. But some courts went months or years without an update – without facing any repercussions, according to state audits.
Some reasons for not reporting..
East Cleveland
Per the Clerk of Courts she is not reporting and will not be reporting until she gets help in the court. BCI Staff asked her several times if we could help or come pick up dispositions. She reported it would take too much time to go through the paperwork and her court does not have the money to make that many copies. She said she may start to report future dispositions but for now cannot. BCI Staff told her she could call or email anytime if she needed help.

That's the sign of a court not being updated. If the court system is computerized at all then it should be a non issue. The mayor's court where I worked use to do it by paper until we upgraded the court with a new computer software. The new software submits the final disposition to BCI when it is entered into the court management system which is what provides our online docketing and everything else. The only key is making sure the tracking number is entered into the case once the person is fingerprinted. Otherwise, nothing links the final disposition to the case on a person's BCI record, and then it becomes a lost record.

Its fascinating talking to the folks at CJIS/NICS and the complexity they face getting this info. Some courts only spend 1 day a year processing requests from them, and thats no joke. Many ar once a week etc... and paper based.... it does need updating, but not on the central FBI side, on the local sides.

Well those courts that aren't reporting on a daily basis had better get their act together and start doing it. Lack of funds to pay for it is no excuse. Kasich has demanded it, via his exec. order! :roll:

Perhaps he could've just asked the people in Law enforcement and the court system. :roll:

But had Governor Butthurt done that,he would have lost the opportunity to "virtue signal" his opposition to Ohioans' RKBA.

Yesterday's hearing was not well attended.
Only eight people showed up to speak last night at a Columbus City Council hearing on proposed gun regulations.

"This package was about keeping our community safe. It's about doing what we can do as a city to make sure that we are abating gun violence in Columbus."

Monday evening, Chuck LaRosa with Ohioans for Concealed Carry gave this statement:

"We've already been in touch with our attorneys and we believe there may be numerous actionable violations of state law."

LaRosa says the organization is looking carefully at what was passed and will plan its next steps, which could include legal action.

Time to turn things in.
A spokeswoman for Columbus City Attorney Zach Klein said bump stocks can be sold or disposed of before the law takes effect June 13. After that, possessing one is a misdemeanor punishable by up to one year in jail, with a mandatory minimum sentence of 180 days in jail and a $1,500 fine.
“We would discourage the disposal in public trash cans and private trash cans just so the contraband wouldn’t fall into the improper hands,” said Sgt. Dean Worthington, Columbus police spokesman.

Instead, people who own “illegal rate-of-fire acceleration firearm accessories” as defined by the city code can surrender them to the Columbus Division of Police property room at 724 E. Woodrow Avenue. Owners of those accessories also can call the police division non-emergency number, 614-645-4545, to ask for a cruiser to pick up the item for surrender, he said.

So if I am not a resident of Columbus, but drive through there with my friends Bump-Fire enabled AR15, I could be charged if it's discovered during a traffic stop ? kinda flies in the face of ORC 9.68
The "any part" or "Component" is pretty vague as well..
“illegal rate-of-fire acceleration firearm accessories”
The new city law defines those illegal accessories as “any trigger crank, a bump-fire device, or any part, combination of parts, component, device, attachment, or accessory, that is designed or functions to accelerate the rate of fire of a semi-automatic firearm but not convert the semiautomatic firearm into an automatic firearm.” It includes bump stocks, slide fires and accelerators, among others.

Worthington said police likely won’t be actively searching for those items, but someone who illegally possesses one could be charged if it is discovered during a traffic stop or other searches and investigations.

...so the Geissele N. Match trigger set on my TARGET RIFLE is banned now, for the 13 minutes I travel through Columbusstan to an NRA sanctioned match?

And their jails, like any other large city, is bulging to 4,381% over capacity, Now.Where-O-where are they going to dream up allll that extra space for these new violators?
