This sub-forum is strictly for the purpose of submitting of, and status updates related to, ORC 9.68 compliance. This could mean park bans, open carry bans, or anything that is a compliance issue. Note the format in which original threads were created. We'll track each individual case here and post updates if assistance is needed, etc. You may start a new thread here to notify us of a non-compliant scenario. Please try to research contact information for each city, village, etc, Email, fax, and postal addresses are great. Digital photos of infractions (Signs) are ideal. Ashtabula county fairgrounds

I was at our county fairgrounds and it is posted which I thought was in violation of ORC 9.68. Can anyone look into this order is there a copy n of a letter I can said to the fair board to make them aware they are in violation? Thanks

If their "No Guns" signs are on the fairground fences or gates, they are posted illegally.

ITEM #1

The Agricultural Society is NOT a private company.

The Ashtabula County Agricultural Society is formed under Ohio Revised Code 1711.

As per R.C. 1711.13, the Society is a body politic, making it a political subdivision of the State of Ohio, and subject to all general laws of the State.

This was confirmed by the Supreme Court of Ohio in "Greene Cty. Agricultural Soc. v. Liming, 89 Ohio St.3d 551, 2000-Ohio-486".


ITEM #2

Ohio Revised Code 9.68, a general law of the State of Ohio, does not allow for restrictions on firearms possession or carrying other than found in state and federal law.

By posting a "No Guns" sign or having any rules or regulations prohibiting or restricting firearms, the Agricultural Society is violating State law.


Item #3

Ohio Revised Code 1711.13 allows that an agricultural society may sue and be sued.

Ohio Revised Code 9.68 allows for the awarding of costs and attorney fees to any entity who may sue the Society for a violation thereof.

To prevent such a lawsuit, the Society should immediately remove any unauthorized "No Guns" signs and stop enforcing ANY AND ALL restrictive firearms rules or regulations that may currently be in place.


ITEM #4

Certain buildings, as per Ohio Revised Code 2923.1212, MAY be posted with "No Guns" signs. The exceptions are as follows:


A) Any building that is PRIMARILY A RESTROOM or rest facility cannot be posted.


B) Any building that is PRIMARILY A SHELTER cannot be posted. This includes any "roof on poles" picnic shelters as well as the seating area of most grandstands. Enclosed areas under the seating area may (usually) be posted.

Buildings primarily used as animal barns are also shelters and cannot be posted. However, if an animal barn has office areas (fair, maintenance or auction offices, for example...not just storage rooms) the entire building may be posted.


C) Any building that is PRIMARILY A PARKING FACILITY cannot be posted. This includes ANY building that is used for vehicle storage.

Many Agricultural Societies will rent out building space for storage of passenger vehicles, RV's, motorcycles, boats, trailers and other similar items during the winter months. The courts will look at the number of weeks the buildings are used for parking OR ARE AVAILABLE for parking and compare that total to the number of weeks the building is used for other events. If the building is used more for parking than events, the building cannot be posted.


I am certain your county prosecutor or other chosen legal counsel can confirm this information with the Ohio Attorney General's office.
