RENEWAL DENIED?
Not exactly, the sheriff office refused to process my renewal. I left off my Social Security number as it is optional and I think even law enforcement should obey the law. Their excuse is BCI wont process an application without one. Evidently this agency is under the impression they can rewrite the law. I have heard that Hocking County doesn't require the SS#. If true, I wonder how that works if in fact BCI wont process with out one. Maybe they access the Drivers License data base. I wonder if that is even legal. I am surprised my sheriff doesn't use the one on my original application. They may in fact use that against me in the future. So tomorrow I'll see if I can find a lawyer interested in taking the case. It should be interesting in any case.

So, which county were you dealing with? I suggest you post that much here, and let one of OFCC'S compliance specialists see what they can offer, before hiring an attorney on your own. We got some pretty sharp folks pitching in around here.

If you want to be a smart-azz about it (as I would), ask them why the spot on the application for "Social Security Number" says "(optional)".
Tell the Sheriff, politely, to accept your application (and fee) and to please forward you the written rejection letter (or email) they should receive from BCI if what they say is true.

Jackson, their excuse this time is the software wont let them proceed without the SS#. Last time I raised the question when my wife applied and they said BCI wouldn't proceed with out the SS. I suspect only a mandamus action would break this logjam.

I intend to write a letter to the sheriff today, my position is they did accept my application when they entered it into the computer. They have 45 days starting yesterday.

I agree, in fact, I did watch the info being entered into the program. It really wont proceed without the number. My position is so what? My understanding is the law says they have 45 days unless they get disqualifying information. MWSY is that your understanding?

1) Did the Sheriff take and keep your application, or did they return it to you before you left?
2) Did the Sheriff take and keep your application FEE, or did they return it to you before you left?
If they returned both your app AND your fee, I doubt any judge would consider the clock started.
If they kept BOTH, the clock is ticking.
And, as far as the software 'requiring' your 'optional' SS number, there should be nothing stopping the Sheriff from bypassing the software and phoning in your info to BCI directly.
I concur that non-compliant software is NOT your concern.

They did keep the application. We didn't get to the fee. I believe I should start over, complete a new application and include the fee and mail it(registered) to the sheriffs office. Even if they return it, that should satisfy the judge the clock is ticking. I'm thinking the end of the week(payday).

Pretty sure the application and fee have to be turned in in person. Finger prints can't be taken over registered mail.

Do I need fingerprints for a renewal? Update; I have a USPS package slip from the Sheriffs office. I bet they have returned my application. Hmmm! I believe I should discuss this with our attorney before proceeding.

Yes. For a record to come back from BCI it is done on a fingerprint based match. The name, date of birth, social, etc only search if the prints are not able to be ready by the computer for some reason.slidelock wrote:Do I need fingerprints for a renewal? Ah, I wasn't sure if I needed to provide fingerprints for a renewal. I was hoping to ensure I had a credible application and start the clock ticking by mailing in the application and fee.
