If I saw ANYONE walking down the street with a gun IN THEIR HAND I'd call 911 immediately. If its a rifle on a sling or a pistol in a holster its a different ballgame.

Hunters carry shotguns in their hands all the time. The only difference is that a hunter would (should) be wearing an orange vest.

I don't think they are so fond of this idea down on the Arizona border, unless you are using sarcasm, in which case, it doesn't go over well on the internet unless you make it obvious.

Hal2000 wrote:There is no law that says you have to carry a handgun in your holster outside of a car, however if I walked into a Wendys that you were in with a gun in my hand i'll bet you would assume I was up to no good. There is no law that says a homeowner has to enter his home via a door so if I see someone climbing into a house window I should not call the cops?

Again, how about you guys "man up" on your little "theories" and "beliefs" and walk into Wendys with your gun in you hand and when panic ensues, just tell the officer arriving on the scene first ,,,"Really officer I didn't mean to incite panic, besides there's no law against me doing this right?"

Now if I'm playing chess here, I'm going to assume that someone is going to move to this square...

"yea but the kid was clearly doing nothing to incite pannic"

Maybe easy for you to say driving by in a car 25 yards away with a viable means of escape and limited exposure due to no proximity threat, but let's say you have a mother out walking and pushing her baby carriage coming down the sidewalk in the opposite direction. Or... your wife , daughter, mother walking there and they are alone talking to you on your cell phone, do you tell them " no big deal its just some teens with a shot gun, just ask them if they shot any rabbits".

middle of the day, someone climbing into the house through window, yes call the cops, or ..just don't get involved its somebody elses problem.

I was not, and I don't care what they think of it in Arizona. The right to self-defense and therefore arms is a natural right and it does not come from the constitution, and therefore is a right of all men and women of every color and origin. Just because most other countries have no respect for that right does not mean it is ours to control. I'm not trying to make you see things my way and I have no interest in you inevitable fear-based disagreement with my view. If I'm armed it doesn't matter who else is armed.

Your arguments are juvenile to the point that I have to wonder if the 93 in your username refers to the year you were born. Nobody here is even defending in-hand carry of anything other than a long gun in an outdoor context, and regardless it IS legal and it doesn't meet the legal definition of Inducing Panic, ORC 2917.31 (http://codes.ohio.gov/orc/2917.31). I'm guessing that you are the type of person that thinks it's okay to bend the law if it means a kid with a shotgun on the street gets hassled.

It's not a urination contest, it's a discussion of what is legal, and most of us prefer that law enforcement only enforce laws that are real, as they are codified, and that they know what they are talking about. If something is legal, it should not be cause for a stop.

As a non-legal matter, a handgun in the hand is almost always an offensive or defensive condition, whereas a long gun in the hand may also be a neutral condition. If I have a break-action shotgun open with the barrels pointing to the ground you'd be hard pressed to define that as anything other than a safe condition... in the context of the outdoors. A weapon in the hand may be considered a threat, but it is not illegal in this state.

I'll do it for him - IT'S NOT ILLEGAL! What ORC are you reading from?

Yes, it will almost certainly get the police called, and yes, it's a bad idea. But if you have a shotgun without a sling or a case, and you're walking down the street to a friend's house to go hunting for the day (or any other of a million scenarios), you may have no choice but to walk down the street with a shotgun in your hand.

Regardless of the reason he was doing it, it's NOT ILLEGAL, and I certainly wouldn't call 911 unless there was some other factor.

However, Hal2000 made a couple good points :

1> there is no law that says a homeowner must enter through his front door, but if I saw someone entering through a window, I would call the police.

and :

2> if I were walking down the street with a long gun in my hand, I would expect a MWAG call and police to check me out. Nothing wrong with that.

There was a case a few years ago in Idaho in which two brothers, both under 21 as I recall, routinely carried rifles with them for self defense. Handguns were out of the question for their ages. I do remember that they might have had the rifles slung.

It made the papers because of all the MWAG calls that were coming in. They were perfectly legal with what they were doing. The police were asked to check out the object of calls, and knew the young men on sight, so that hassles were reduced to a minimum.

I'm not sure what to think about the OP's sighting. It may be disconcerting, but I am not sure it merited alarm bells. Perhaps a look-see by LEO may have been in order, but it sounds like it was nothing to be stressed over.

The brothers lived in Post Falls, ID.
Ages 15 and 18.
Just down the road from my home town, Spokane, Wa.

Video: http://www.youtube.com/watch?v=g5bVhzLwkU0

Spokesman Review story: May 31, 2007
POST FALLS – Zach Doty typically wears a tie and dress shirt to church. But lately, a new accessory of his is raising alarm in Post Falls.

After turning 18 last month, the Post Falls teenager began strapping a loaded 9 mm Glock 19 handgun to his belt every day. He totes it in full view to Bible studies, the public library, city parks and neighborhood stores and on walks around town.

His 15-year-old brother, Stephen, has joined him, carrying a loaded Ruger .22-caliber rifle slung over his shoulder.

I can't remember what I had for lunch yesterday or the names and faces of the OFCC members that have come by my house and spent hours with me stuffing envelopes but I can remember reading a story about two gun totin' teens from three years ago.
The fact that it occurred in Post Falls where a lot of my nieces and nephews live may have something to do with it.

Be that as it may, thank you for the compliment.

Before 9/11 it wasn t illegal to take a boxcutter on an airliner. How did that work out?

The box cutters were not the problem, removing them did not cure the problem either.

The root cause of the problem was letting a small group of people take over an airplane with box cutters.......if they tried again they would be torn limb from limb probably, hopefully, at the very least they will not again take over an airplane that way........and that has nothing to do with making it illegal to carry a box cutter on an airplane..........it has to do with the mindset of the intended victims, and the people in the cockpit.

Actually the root cause was a belief that there should be an interior door separating the pilot from the passengers. Had the cockpit only been accessible from the outside while on the ground there would be no way for anyone to take over the fight deck of a plane in flight.
